Alfaro St., Salcedo Village Makati City Dear Mr. Corpus: This refers to your letter dated May 5, 1982 requesting clearance for the use of the company name Asian Managerial Finance Center per instruction of the Bureau of Domestic Trade in connection with the renewal of your license due to expire on May 5, 1982. cdlex Although it appears that your company is actually engaged in organizing seminars of various finance topics such as financial management, cash management and the like, nevertheless the name of said firm creates the impression that is engaged in financial pursuits. In this regard, Republic Act No. 5980, as amended provides that: SECTION 7. . . . (c) . . . No person, association, partnership, or corporation shall hold itself out as doing business as a "financing company" or "finance investment company" or any other title or name tending to give the public the impression that it is engaged in the operations and activities of a financing company , unless so authorized under this Act. However, considering the goodwill that your firm may acquire since it has been using the said name since 1977, we suggest that you can use a substantially similar name like "Asian Center for Managerial Finance" or "Asian Managerial Finance Study Center." We believe that this is a good compromise for the Bureau of Domestic Trade, your organization and the Securities and Exchange Commission. Please be advised accordingly. Very truly yours, (SGD.)
