February 21, 2008 SEC EN BANC CASE NO. 12-07-0306 IN THE MATTER OF PACIFIC-WORLD BUILDING MANAGEMENT AND GENERAL SERVICES, INC. (SEC Reg. No. AS094-008082) , petitioner. FOR: LIFTING OF ORDER OF REVOCATION OF CERTIFICATE OF REGISTRATION O R D E R Petitioner Pacific-World Building Management and General Services, Inc. is a stock corporation registered with the Commission on 07 September 1994. The primary purpose of the corporation is: "To engage in office and building maintenance services such as janitorial, messengerial, pest control services, building management, maintenance and administration and other allied services." Its principal office is located at 2/F RB & S Place, Ortigas Extension, #30 Rosario, Pasig City. On 03 November 2003, petitioner's Certificate of Incorporation No. AS094-008082 was revoked for non-compliance with the Commission's reportorial requirement, pursuant to the Order dated 30 September 2003 which was published in a newspaper of general circulation on 04 October 2003. Petitioner now prays for the lifting of the said Order of Revocation on the following grounds: DEIHAa 1. The officer-in-charge who was responsible for the filing of the reportorial requirements has resigned; 2. The officer who replaced the former officer was not aware of the submission of the reportorial requirement; and 3. The corporation was continuously operating since the date of its registration. In support of its Petition, petitioner submitted the following documents: 1. 2007 and 2008 Business Permit issued by Pasig City on 22 January 2007 and 30 January 2008, respectively and 2. 2006 Annual Income Tax Return (BIR Form No. 1702); ECTHIA Petitioner further alleges that it has no intention to violate the law and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. In fact, petitioner paid the penalty on 10 December 2007 amounting to Fifty Thousand Pesos (P50,000.00) as evidenced by Official Receipt No. 0123223. Further, petitioner is hereby directed to amend its Articles of Incorporation by changing its principal office from Banker's Centre, 6764 Ayala Avenue, Makati City, Metro Manila to 2/F RB & S Place, Ortigas Extension, #30 Rosario, Pasig City within thirty (30) days from date of receipt hereof. Failure on the part of petitioner to comply with the directive shall cause the recall of the instant Order. WHEREFORE, premises considered, the Order of the Commission dated 30 September 2003 revoking the Certificate of Registration of Pacific-World Building Management and General Services, Inc. is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD) and the Economic Research and Information Department (ERID) of this Commission for their appropriate action.
