March 19, 2008 SEC EN BANC CASE NO. 12-07-0305 IN THE MATTER OF ST. PIUS X INSTITUTE, INC. (SEC REG. NO. 20300) , petitioner. LIFTING OF THE ORDER OF REVOCATION OF THE CERTIFICATE OF REGISTRATION O R D E R Petitioner ST. PIUS X INSTITUTE, INC. is a non-stock corporation registered with the Commission on February 5, 1962 to "give a sound, complete and Catholic education to children and youth in the Philippines and to promote their intellectual and moral development". It has its business office address at Aguila St., Cuyapo, Nueva Ecija. In an Order dated April 22, 2003, Petitioner's Certificate of Registration was ordered revoked for non-compliance with the Commission's reportorial requirements. Such Order was published on April 25, 2003 and became effective on May 26, 2003. Petitioner now prays for the lifting of the said order of revocation on the ground that the corporation is still existing and operational. As proof of its operation, Petitioner submitted the following: 1) Certification from the Office of the Municipal Mayor dated November 16, 2007 that petitioner is existing and under the directorship of Rev. Rufo Ramil H. Cruz; 2) Latest Enrollment Report Transmittal to the Department of Education; 3) Scholarship Grants-Educational Service Contracting; 4) Latest Receipt from Digital Telecommunications Philippines, Inc. (Due date August 28, 2007); DEcTIS 5) Official Receipts issued by Petitioner (March 21, 2007; April 10, 2007); 6) Copies of the Minutes of a board meeting held on April 30, 2007; 7) Indorsement dated June 13, 2007, Application dated July 17, 2007 for Tuition Fee Increase for School Year 2007-2008 (together with its attachments); 8) Latest Social Security System (SSS) Payment dated June 13, 2007; 9) Memorandum of Agreement dated September 7, 2007 with the Dominican High School whereby Petitioner extended financial assistance by way of a long term loan for the amount of Five Hundred Thousand Pesos (P500,000.00); 10) Income Tax Return for the year 2006; 11) Financial Statement for the year 2006-2007. Petitioner further alleges that it has no intention to violate the law and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. It also paid in full the penalty of Eighty Thousand Five Hundred Pesos (P80,500.00), as evidenced by Official Receipt No. 0121466 dated December 10, 2007, which amount was assessed by the Law and Regulation Division of the Company Registration and Monitoring Department (CRMD). WHEREFORE, premises considered, the Order of the Commission dated April 22, 2003, revoking the Certificate of Registration of ST. PIUS X INSTITUTE, INC. is hereby SET ASIDE. Petitioner is hereby directed to submit its Mayor's Permit for the year 2008. Failure to comply with this directive shall cause the recall of this Order. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD) for implementation and attachment to the corporate records of petitioner on file with the Commission. The Economic Research and Information Department (ERID) is hereby directed to delete the name of Petitioner from the List of Revoked Corporations immediately upon receipt of this Order. SO ORDERED.
