January 20, 2009 SEC EN BANC CASE NO. 11-08-0563 IN THE MATTER OF STI COLLEGE OF KALOOKAN, INC. SEC REGISTRATION NO. AN95002077 FOR : Setting Aside the Order of Revocation of the Certificate of Registration O R D E R Petitioner, STI COLLEGE OF KALOOKAN, INC. is a non-stock corporation registered with the Commission on June 6, 1995, under SEC Registration No. AN95002077, with office address at 357 G.M. Sandoval Building, J. Teodoro St., 10th Avenue, Caloocan City, organized to operate an institution for computer education, as stated in its Articles of Incorporation. aATHIE On November 3, 2003, its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated September 30, 2003, published on October 4, 2003 in the Philippine Daily Inquirer, for non-filing of reports. Petitioner now prays for the setting aside of the Order of Revocation dated September 30, 2003, on the following grounds: 1. that none of the trustees, officers or members received the notice of revocation; 2. that it is continuously operational since its incorporation and had been granted permits by the Commission on Higher Education and the Technical Education and Skills Development Authority with 3,059 graduate students of various degrees; 3. that there are 2,165 students currently enrolled which shall be adversely affected if Revocation Order is not set aside; 4. that it has no intention to violate the law and any of the Commission's rules and regulations; and 5. that it commits to submit the reportorial requirements religiously. In support of its Petition, Petitioner submitted the following documents: 1 1. Trustees' Certificate dated September 9, 2008, certifying that at the special meeting of the members and the Board of Trustees', held on March 25, 2008, at which a quorum was present, the resolution allowing the filing of Petition to Set Aside Order of Revocation was approved; 2. Copy of Petitioner's Summary of Enrollment for the First Semester SY 2008-2009; 3. Photocopy of the 2008 Mayor's Permit, Caloocan City; 4. Photocopy of Government Permit No. V-0016, series of 1995 issued by the Department of Education Culture and Sports, Quezon City, granting Petitioner authority to operate programming courses for the school year 1995-1996; DITEAc 5. Photocopies of Government Recognitions issued on various dates in 2008, 2006, 2004, 1997 and 1995 by the Commission on Higher Education, granting Petitioner authority to operate certain courses; 6. Photocopies of Certificate of TVET Program Registration issued on various dates in 2005, 2001 and 1996 by the Technical Education and Skills Development Authority, National Capital Region, granting Petition authority to offer certain programs; and 7. Affidavit of Ana Bella V. Corotan, Petitioner's legal counsel, explaining the minor discrepancy as to the name of Petitioner appearing in the Government Permit and Recognitions and Certificates of TVETS Program Registration. Petitioner submitted its 2008 General Information Sheet and 2007 Financial Statements to prove its intention to continue its registration with the Commission. On November 25, 2008, Petitioner paid the fine of P55,500.00 under Official Receipt No. 0234376, for non/late filing/registration of the following, on the years indicated hereunder: NOT FILED FILED LATE General Information Sheet 1996-2007 Financial Statements 1996-2006 Membership Book Registered Late WHEREFORE, finding the Petition meritorious, the Order of the Commission dated September 30, 2003, revoking the Certificate of Registration of STI COLLEGE OF KALOOKAN, INC., is hereby SET ASIDE. Further, Petitioner is directed to submit favorable endorsement from the Commission on Higher Education, Technical Education and Skills Development Authority and Department of Education within thirty (30) days from receipt of this Order.
