March 11, 2008 SEC EN BANC CASE NO. 11-07-0285 IN THE MATTER OF DOMINICAN HIGH SCHOOL OF STO. DOMINGO, N.E., INC. (SEC REG. NO. 34635) , petitioner . FOR: SETTING ASIDE ORDER OF REVOCATION O R D E R Petitioner DOMINICAN HIGH SCHOOL OF STO. DOMINGO, N.E., INC. is a non-stock corporation registered with the Commission on 04 March 1968. 1 Petitioner was constituted to engage in the general instruction, education, character and religious formation of the youth and to establish schools and colleges to accomplish the general instruction and education of the youth. 2 Its principal office is located at 69 Real Street, Poblacion, Sto. Domingo, Nueva Ecija. On 02 July 2003, petitioner's Certificate of Registration No. 34635 was revoked by virtue of SEC Order dated 27 May 2003 for non-compliance with the Commission's reportorial requirements. Said order was published in a newspaper of general circulation on 02 June 2003. Petitioner seeks reconsideration of the Order revoking petitioner's registration on the ground that it is still existing and in operation. 3 As proof of its continued operation, petitioner submitted copies of the following: 1. 2007 Annual Income Tax Return; 2. 2006 Audited Financial Statements; 3. Certification dated 07 August 2007 issued by the Municipal Planning and Development Office of Santo Domingo, Nueva Ecija certifying that petitioner is operating as a religious educational institution from 2003 up to the present; DEScaT 4. Memorandum of Agreement entered into by St. Pius X Institute and petitioner for an extension of financial assistance by the former to the latter notarized on 07 September 2007; 5. Memorandum of Agreement entered into by Our Lady of Sacred Heart Academy and petitioner for an extension of financial assistance by the former to the latter notarized on 07 September 2007; 6. Official Receipt No. 3990 dated 11/12/2007 issued by petitioner; 7. Minutes of Year-end Board Meeting of the Board of Trustees of petitioner held on 12 April 2007; and 8. SSS Contributions Payment Return (R-5) dated 26 October 2007. Petitioner further alleges that it has no intention to violate the law and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. As a matter of fact, petitioner already paid the penalty in the amount of FIFTY SIX THOUSAND SEVEN HUNDRED FIFTY PESOS (Php56,750.00) on 19 November 2007 as evidenced by Official Receipt No. 0116539. ETCcSa WHEREFORE, premises considered, the Order of the Commission dated 27 May 2003 revoking the Certificate of Registration of DOMINICAN HIGH SCHOOL OF STO. DOMINGO, N.E., INC. is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department and the Economic Research and Information Department of this Commission for their appropriate action.
