February 20, 2009 SEC EN BANC CASE NO. 11-07-0282 IN THE MATTER OF CALANTAS FOUNDATION, INC. SEC REGISTRATION NO. AN94004013 FOR : Setting Aside the Order of Revocation of the Certificate of Registration O R D E R Petitioner, CALANTAS FOUNDATION, INC., is a non-stock corporation registered with the Commission on 19 October 1994, under SEC Registration No. AN94004013, with principal office address at Aramaywan, Narra, Palawan, organized to operate an orphanage center at Aramaywan, Palawan, as stated in its Articles of Incorporation. AcTDaH On 3 November 2003 its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated 30 September 2003, published on 4 October 2003 in the Philippine Daily Inquirer, for non-filing of reports. Petitioner now prays for the setting aside of the Order of Revocation dated 30 September 2003, on the ground that it is existing and operational. In support of its Petition, Petitioner submitted the following documents: * 1. Photocopy of its 2007 Mayor's Permit, Narra, Palawan; 2. Photocopy of its Certificate of Business Name Registration, issued by Rosenda G. Fortunado, Provincial Director, Department of Trade and Industry on 21 March 2007; 3. Photocopy of Petitioner's Bureau of Internal Revenue Certificate of Registration dated August 31, 2007; and 4. Photocopy of its 2006 Annual Income Tax Return, received by the BIR on October 5, 2007. On 28 February 2008 an Order was issued by the Commission's Office of the General Counsel (OGC) directing Petitioner to: pay the assessed penalty of PhP55,500.00; observe the pertinent provisions of the SEC Guidelines on Foundation; and submit its 2008 Mayor's Permit, with a warning that failure to abide with the directive shall cause the dismissal of the Petition without prejudice. The OGC Order was returned to sender ( i.e., The Commission) for the reason that it was unclaimed despite notice to claim such on March 31, 2008, April 9, 2008 and April 16, 2008. To date, Petitioner has not complied. Considering the length of time that lapsed, we find it as lack of interest on the part of the Petitioner to pursue its Petition.
