March 10, 2008 SEC EN BANC CASE NO. 11-07-0271 IN THE MATTER OF SOUTH CHRISTIAN MISSION CHURCH, INC. (SEC REG. NO. A1997-11704), petitioner. FOR: LIFTING OF ORDER OF REVOCATION O R D E R Petitioner is a non-stock corporation registered with the Commission on 28 July 1997 as a religious organization. On 15 March 2004, petitioner's Certificate of Registration No. A1997-11704 was revoked for non-compliance with the Commission's reportorial requirements, pursuant to the Order of Revocation dated 10 February 2004 which was published in a newspaper of general circulation on 14 February 2004. Petitioner now prays for the lifting of the said Order of Revocation based on the grounds that it did not receive any notice of the revocation and that if such revocation is not set aside, its church activities and other religious exercises will be negatively affected. In support of its Petition, petitioner submitted as proof of its continued operation: DcHSEa 1. Certification dated 6 September 2007 issued by the Municipal Mayor of General Mariano Alvarez, Cavite stating that petitioner is a religious organization of good repute holding religious rites/gathering at its address within the municipality, which is devoted actually, directly and exclusively for such rites; 2. Invitation to the Graduation Day of petitioner's Vacation Bible School 2007; and 3. Church Rites Pamphlets in 2005 and 2006. Petitioner alleges that it intends to continue its operations as evidenced by its submission of its most recent General Information Sheet and Financial Statements. It further alleges that it has no intention to violate the law and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. It has also paid in full the total amount of penalty of Nine Thousand Five Hundred Pesos (Php9,500.00) as assessed by the Law and Regulation Division (LRD) of the Company Registration and Monitoring Department (CRMD) and evidenced by Official Receipt No. 0110950. WHEREFORE, petitioner's allegation of lack of notice of revocation is without merit considering that the Order of this Commission dated 10 February 2004 was published in a newspaper of general circulation on 14 February 2004. However, finding the documents submitted to support the instant petition of SOUTH CHRISTIAN MISSION CHURCH, INC. to be sufficient, the aforesaid Order is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD) and the Economic Research and Information Department (ERID) of this Commission for their appropriate action.
