March 25, 2008 SEC EN BANC CASE NO. 11-07-0261 IN THE MATTER OF CENTER FOR LABOR EDUCATION ADVOCACY, RESEARCH AND DEVELOPMENT, INC. (SEC REG. NO. 180632) , petitioner . FOR: SETTING ASIDE ORDER OF REVOCATION O R D E R Petitioner CENTER FOR LABOR EDUCATION ADVOCACY, RESEARCH AND DEVELOPMENT, INC. is a non-stock corporation registered with the Commission on 23 August 1990. 1 Petitioner was organized primarily to assist the U.P. School of Labor and Industrial Relations (U.P. SOLAIR) in the realization of its two-fold mission the promotion of labor empowerment and an enlightened industrial relations system through the conduct of relevant and timely research, training, community service and other related programs. 2 Its principal office is located at the Bonifacio Hall, U.P. SOLAIR, Jacinto Street, U.P. Campus, Diliman, Quezon City. On 29 September 2003, petitioner's Certificate of Registration No. 180632 was revoked by virtue of SEC Order dated 20 August 2003 for non-compliance with the Commission's reportorial requirements. Said order was published in a newspaper of general circulation on 28 August 2003. Petitioner seeks reconsideration of the Order revoking petitioner's registration on the following grounds: 1. The staff in charge of the filing of the reportorial requirements left without endorsing the same to her replacement; and 2. The revocation order of 20 August 2003 and the corresponding publication of said revocation on 28 August 2003 did not reach the officers and trustees of petitioner. 3 As proof of its continued operation, petitioner submitted copies of the following: IHEDAT 1. 2006 Annual Income Tax Return; 2. 2006 Audited Financial Statements; 3. Sertipikasyon dated 02 November 2006 issued by the Punong Barangay of Barangay U.P. Campus, Diliman, Quezon City stating that petitioner holds office at U.P. SOLAIR, Diliman, Quezon City; 4. Lease Contract for January to December 2007 signed by the representatives of U.P. SOLAIR and of petitioner; HSDIaC 5. Business Clearance issued by the Punong Barangay of Barangay U.P. Campus, Diliman, Quezon City on 22 June 2007; 6. 2007 General Information Sheet; 7. Various flyers on the seminars offered by petitioner; and 8. 2007 Training Calendar of petitioner. Petitioner further alleges that it has no intention to violate the law and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. As a matter of fact, petitioner already paid the penalty in the amount of FIFTY FIVE THOUSAND PESOS (Php55,000.00) on 08 November 2007 as evidenced by Official Receipt No. 0113048. WHEREFORE, premises considered, the Order of the Commission dated 20 August 2003 revoking the Certificate of Registration of CENTER FOR LABOR EDUCATION, ADVOCACY, RESEARCH AND DEVELOPMENT, INC. is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department and the Economic Research and Information Department of this Commission for their appropriate action.
