December 7, 2007 SEC EN BANC CASE NO. 10-07-0241 IN THE MATTER OF GRACE CHRISTIAN HIGH SCHOOL, INC. (S.E.C. REG. NO. 5197) , petitioner. SETTING ASIDE OF THE ORDER OF REVOCATION ORDER Petitioner GRACE CHRISTIAN HIGH SCHOOL, INC. is a non-stock corporation registered with the Commission on June 8, 1950. 1 The primary purpose for which said corporation is formed is to establish, maintain, and operate an institution or institutions of learning for Filipino as well as Chinese students and students of any other nationality in the Philippines. 2 Its principal office address is located at Grace Village, Sto. Domingo Street, Quezon City. HcDaAI On May 26, 2003, petitioner's Certificate of Registration No. 5197 was revoked by virtue of SEC Order dated April 22, 2003 for non-compliance with the Commission's reportorial requirements. Said Order was published in a newspaper of general circulation on April 25, 2003. Petitioner now prays for the setting aside of the said order of revocation based on the following grounds: a) The non-filing of the required reports is caused by mere oversight of the employee; and b) The revocation of the petitioner's registration will prejudice the interests of its students and personnel. As proof of its continued operation, petitioner submitted the following: a) 2007 Mayor's Permit No. 99-018496 issued by the City Mayor of Quezon City as well as Mayor's Permits for 2005 and 2006; b) 2006 Certification issued by the Department of Education attesting that petitioner has been in continuous operation from the date of its incorporation; EaIcAS c) 2007 General Information Sheet; and d) Audited Financial Statements as of April 30, 2007. Petitioner further alleges that it has no intention to violate the law and any SEC rules and regulations and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. It has also committed to pay immediately any penalties due by reason of its failure to comply with the Commission's reportorial requirements. In fact, it paid the penalty in full as evidenced by Official Receipt No. 0107689, dated October 18, 2007 amounting to SIXTY THOUSAND EIGHT HUNDRED PESOS (P60,800.00). WHEREFORE, finding the petition meritorious, the Order of the Commission dated April 22, 2003 revoking the Certificate of Registration of GRACE CHRISTIAN HIGH SCHOOL, INC. is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department and the Economic Research and Information Department of this Commission for their appropriate action.
