February 12, 2008 SEC EN BANC CASE NO. 10-07-0238 IN THE MATTER OF CLAIMANTS 1081 INC. (SEC REG. NO. AN095-00398) , petitioner. FOR: SETTING ASIDE OF THE ORDER OF REVOCATION OF CERTIFICATE OF REGISTRATION O R D E R Petitioner Claimants 1081 Inc. is a non-stock corporation registered with the Commission on 6 February 1995 1 with the following purposes: IAEcCT 1. To assist individual claimants in the pursuit and processing of their legitimate claims in a class suit filed against the Marcos estate now pending in the Honolulu District Court; 2. To inform, organize and mobilize claimants in facilitating the efficient processing of their claims regarding the class suit and related Human Rights issues; and 3. To help Human Rights victims especially those who suffered under the Marcos regime, by assisting them in their rehabilitation through livelihood and various programs. 2 Petitioner's business office address is at 130th 13th Avenue Cubao, Quezon City. EcHTCD On 3 November 2003, Petitioner's Certificate of Registration No. AN095-00398 was revoked pursuant to the Order dated 30 September 2003 for non-compliance with the Commission's reportorial requirements. Said Order was published in a newspaper of general circulation on 4 October 2003. Petitioner now prays for the setting aside of the said Order of Revocation based on the ground that "[t]he officers in advertently (sic) neglected to update the filing of SEC required reports as they were too pre-occupied with other matters, private and personal, aside from their activities in assisting and attending to the members on how to go about their claims for damages and reparation as victims of the past regime." In support of its Petition, Petitioner submitted its 2006 General Information Sheet (GIS) and 2006 Audited Financial Statements. Petitioner also submitted, as proof of its continued operation, the following documents: a) Income Tax Return for the year ended December 2006; and b) A News Clipping dated February 11, 2007 from The Sunday Times describing Petitioner's activities. IcTCHD Petitioner further alleges that it has no intention to violate the law and any SEC rules and regulations and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. It has also paid in full the penalty amounting to Ten Thousand Five Hundred Pesos (Php10,500.00) as evidenced by Official Receipt No. 0104705 dated October 17, 2007. WHEREFORE, premises considered, the Order of the Commission dated 30 September 2003 revoking the Certificate of Registration of Claimants 1081 Inc. is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD) and the Economic Research and Information Department (ERID) of this Commission for their appropriate action.
