AN95001633 FOR : Setting Aside the Order of Revocation of the Certificate of Registration O R D E R Petitioner, KIDS OF THE KING CHRISTIAN ACADEMY, INC. is a non-stock corporation registered with the Commission on April 27, 1995, under SEC Registration No. AN95001633, with principal office at B4, Lot 9, Springbeauty St., Antipolo Hills, Antipolo City, engaged in the operation of preparatory/kindergarten, elementary and secondary school, as stated in its Articles of Incorporation. EHSTDA On November 3, 2003, its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated September 30, 2003, published on October 4, 2003 in the Philippine Daily Inquirer, for non-filing of reports. Petitioner now prays for the setting aside of the Order of Revocation dated September 30, 2003, on the ground that despite non-filing of reports, it is in continuous operation since its incorporation up to the present. In support of its Petition, Petitioner submitted the following documents: 1 1. Trustees' Certificate dated December 31, 2007, certifying that at the regular meeting of the members and the Board of Trustees', held on December 31, 2007, at Antipolo City, at which a quorum was present, the resolution allowing the filing of Petition to Set Aside Order of Revocation was unanimously approved; 2. Minutes of Meetings held on February 2, 2008, March 30, 2007 and January 5, 2007; 3. Photocopy of the Certification dated August 22, 2007, certifying that Petitioner is maintaining a well-handled account with the Allied Banking Corporation; 4. Photocopy of letter dated August 14, 2007 issued by the Department of Education, Region IV-A (CALABARZON), Rizal, Pasig City, on the acknowledgment of the Petitioner's increase of tuition and other school fees and charges; 5. Photocopy of Billing Statements dated August 8, 2007 issued to the Department of Education, Pasig City; and 6. Photocopy of Reports on Secondary Promotions dated April 18, 2001, April 10, 2000, March 31, 1999, and Report on Promotions for Grade III dated April, 1997. Petitioner submitted its 2007 General Information Sheet and 2007 Financial Statements to prove its intention to continue its registration with the Commission. Petitioner also manifested that it has no intention to violate the law and it commits to immediately pay the fines due. On September 16, 2008, the corporation paid the fines of P12,500.00 under Official Receipt Nos. 0207869, for non/late filing/registration of the following, on the years indicated hereunder: ICASEH NOT FILED FILED LATE General Information Sheet 1996-2004; 2006 2005 and 2007 Financial Statements 1996-2004; 2006 2005 and 2007 Membership Book Registered Late WHEREFORE, finding the Petition meritorious, the Order of the Commission dated September 30, 2003, revoking the Certificate of Registration of KIDS OF THE KING CHRISTIAN ACADEMY, INC., is hereby SET ASIDE. Further, Petitioner is hereby directed to submit its 2008 Mayor's Permit within thirty (30) days from the date of receipt hereof.
