FOR: SETTING ASIDE THE ORDER OF REVOCATION OF THE CERTIFICATE OF REGISTRATION O R D E R Petitioner, SAMAHANG TABORIE, INC., is a non-stock corporation registered with the Commission on 17 May 1991 under SEC Registration No. 0000190775, with principal office address at #05 Gahak, Kawit, Cavite, organized to promote environmental awareness and protection, as stated in its Articles of Incorporation. TSADaI On 29 September 2003, its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated 20 August 2003, published on 28 August 2003 in the Philippine Daily Inquirer, for non-filing of reports. Petitioner now prays for the setting aside of the Order of Revocation dated 20 August 2003, on the following grounds: 1. that Petitioner from the time of incorporation, has been continuously operating and actively participating in planting bakawans, seminars on fishfarming and environmental protection, particularly on saving the river and on anti-flood activities; 2. that Petitioner is vital in promoting and protecting the water environment of Kawit through bakawan planting, save the river and anti-flood campaign activities; and 3. that Petitioner has pre-feasibility study related to mangrove with the Ecosystems Research and Development Bureau of the Department of Environment & Natural Resources of UP Los Baos. In support of its Petition, Petitioner submitted the following documents: 1 1. Trustees' Certificate dated 30 July 2008, certifying that at the special joint meeting of the Board of Trustees and members, held on 26 July 2008, at its principal office at #05 Gahak, Kawit, Cavite, at which a quorum was present, the resolution allowing the filing of Petition to Set Aside Order of Revocation was approved; 2. Copy of Certification dated 29 August 2008, issued by Kawit Sagip-Ilog & Anti-Flood Group, acknowledging the Petitioner as one of its active members, with attendance of the Group's Luncheon Meeting; 3. Copy of Certification dated 19 August 2008 issued by the Office of Senator Ramon Bong Revilla, Jr. on Petitioner's participation in the bakawan tree planting activity in 1998, and in the Save the River & Anti-Flood project in Kawit, Cavite; 4. Copy of Certification dated 19 August 2008, issued by Mr. Renato del Rosario Broqueza, Head, Livelihood Division of Provincial Cooperative, Livelihood & Entrepreneurial Development Office, that he was the Petitioner's technical speaker in 22 September 2002; HDTISa 5. Copy of Barangay Business Clearance dated 19 August 2008, Barangay Gahak, Kawit, Cavite; 6. Copy of Certification dated 28 July 2008, issued by the Office of the Barangay Chairperson, Barangay Gahak, that Petitioner has been actively participating in the anti-flood campaign, bakawan planting and other environmental activities in the community and nearby barangays since 1991; 7. Copy of Detailed Research & Development Proposal Summary Sheet, a pre-feasibility to be submitted to Ecosystems Research and Development Bureau, Laguna; 8. A copy of instructional bulletin and poster used in their campaign to promote environmental awareness in the community. Petitioner submitted its 2008 General Information Sheet and 2007 Financial Statements to prove its intention to continue its registration with the Commission. It also manifested that it has no intention to violate the law and any SEC rules and regulations and commits to immediately pay the fines as due. On 10 September 2008, Petitioner paid a fine of P12,250.00, under Official Receipt No. 0207508 for non/late filing/registration of the following, on the years indicated hereunder: NOTED DEFICIENCIES YEARS COVERED REQUIREMENTS NOT FILED FILED LATE General Information Sheet 1996-2007 Financial Statements 1996-2006 2007 Membership Book Registered Late WHEREFORE, finding the Petition meritorious, the Order of the Commission dated 20 August 2003, revoking the Certificate of Registration of the SAMAHANG TABORIE, INC., is hereby SET ASIDE.
