FOR: SETTING ASIDE ORDER OF REVOCATION OF CERTIFICATE OF REGISTRATION ORDER Petitioner Tandag Chamber of Commerce and Industry, Inc. is a non-stock corporation registered with the Commission on January 8, 1996, the purpose of which is "to promote and [uphold] the material interest of the PHILIPPINES and the Filipino people in general, and in particular, of the local businessmen engaged in trade, commerce, industry, agriculture and of those [engaged] in the practice of [their] profession." Petitioner's principal office address is at the 3rd Floor of Fedymart Building, Osmea St., Tandag City, Surigao del Sur. On March 15, 2004, petitioner's Certificate of Registration No. DN096-000007 was revoked pursuant to the Order of Revocation dated February 10, 2004 for non-compliance with the Commission's reportorial requirements. Said Order was published in a newspaper of general circulation on February 14, 2004. Petitioner now prays for the lifting of the said Order based on the following grounds: 1. Sometime in November 2004, petitioner submitted its General Information Sheets for the years 1996 to 2004 And its Financial Statements for the years 1996 to 2003 to the Commission's Davao Office, but was not informed that these reports were not in accordance with the Commission's prescribed form; 2. Petitioner was not aware that failure to comply with the reportorial requirement would result in the revocation of its Certificate of Registration; and 3. Petitioner only learned of its revocation in May 2007; In support of its Petition, petitioner submitted its 2006 General Information Sheet (GIS) and 2006 Audited Financial Statement. Petitioner also submitted, as proof of its continued operation, the following documents: 1. Income Tax Return for the year ended December 2006; and 2. Certification from the Secretary General of the Philippine Chamber of Commerce and Industry dated August 16, 2007 that petitioner is a member in good standing thereof. Petitioner further alleges that it has no intention to violate the law and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. It has also paid in full the total amount of the penalty of Fifty-Two Thousand Five Hundred Pesos (P52,500.00) as assessed by the Davao City Extension Office as evidenced by Official Receipt No. 5475567 dated September 25, 2007. WHEREFORE, premises considered, the Order of the Commission dated February 10, 2004 revoking the Certificate of Registration of Tandag Chamber of Commerce and Industry, Inc. is hereby SET ASIDE. Petitioner is further directed to submit the Mayor's Permit for the current year within thirty (30) days from the date of receipt of this Order. Failure on the part of the petitioner to submit the said permit within the aforestated period shall cause the recall of this Order. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD), the Economic Research and Information Department (ERID) and the Davao Extension Office of this Commission for their appropriate action.
