February 18, 2008 SEC EN BANC CASE NO. 09-07-0214 IN THE MATTER OF CASA ILONGGA INCORPORATED (SEC REG. NO. AS093-005659) , petitioner. FOR: SETTING ASIDE OF THE ORDER OF REVOCATION O R D E R Petitioner CASA ILONGGA INCORPORATED is a stock corporation registered with the Commission on July 27, 1993, the primary purpose of which is "to establish, and maintain restaurants, coffee shops, refreshment parlors, cocktail lounges, make, cook, arrange, serve and cater goods, drinks, refreshments and other foods or commodities commonly served in such establishments, and to offer such other services to the public in connection with the operation of restaurant and catery (sic) enterprises. . ." It has its principal office address at 20-A Sta. Monica St., Pasay City. ESaITA On November 3, 2003, Petitioner's Certificate of Registration No. AS093-005659 was revoked for non-compliance with the Commission's reportorial requirements, pursuant to the Order of Revocation dated September 30, 2003 published in the Philippine Daily Inquirer on October 4, 2003. Petitioner now prays for the lifting of said Order of Revocation based on the grounds that: aCTADI a) it did not receive a letter of revocation; b) it failed to comply with its reportorial requirements because the "[p]erson in charge didn't make a turn over before leaving abroad"; and c) it has established goodwill over the years. HAcaCS In support of its Petition, Petitioner submitted the following documents as proof of its continued operation: a) 2006 Annual Income Tax Return; b) 2007 Mayor's Permit; c) 2007 Tourism License; d) 2007 General Information Sheet; and e) 2006 Audited Financial Statements. EcTCAD Petitioner further alleges that it has no intention to violate the law and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. It has also actually paid in full the penalty in the total amount of Eleven Thousand Eight Hundred Pesos (P11,800.00) with the Iloilo Extension Office of the Commission as evidenced by Official Receipt Number 5484805 dated September 7, 2007. WHEREFORE, Petitioner's allegation of lack of notice of revocation is without merit considering that the Order of the Commission dated September 30, 2003 revoking the Certificate of Registration of Casa Ilongga Incorporated was published in a newspaper of general circulation on October 4, 2003. However, finding the documents submitted to support the instant petition to be sufficient, the aforesaid Order is hereby SET ASIDE. aESIDH Accordingly, Petitioner is hereby directed to submit its Mayor's Permit for 2008 within thirty (30) days from date of receipt hereof. Failure to submit the same within the prescribed period shall be an adequate cause for the recall of this Order. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD), Law and Regulation Division, and the Economic Research and Information Department (ERID) of this Commission for their appropriate action. aTcESI SO ORDERED.
