February 15, 2008 SEC EN BANC CASE NO. 09-07-0208 IN THE MATTER OF DAVAO CITY MUSLIM ASSOCIATION, INC. (SEC REG. NO. 78959) , petitioner. FOR: LIFTING OF ORDER OF REVOCATION O R D E R Petitioner Davao City Muslim Association, Inc. ("Petitioner") is a non-stock corporation registered with the Commission on March 30, 1978 under SEC Reg. No. 78959. Its office is located at Prk. 6, 39-D, Islamic Center Compound, Quimpo Blvd., Davao City. ISAcHD On August 11, 2003, Petitioner's Certificate of Registration was revoked pursuant to the Order dated July 8, 2003 for non-compliance with the Commission's reportorial requirements. Such Order was published in a newspaper of general circulation on July 11, 2003. It now prays for the lifting of the Order of Revocation based on the ground that the officers and members of the board of trustees were not aware of the SEC reportorial requirements. They were not also informed of the revocation order and thus they were totally unaware of the revocation of their corporate charter. The grounds relied upon by petitioner in seeking the reconsideration of the Order of Revocation are justifiable. CIDTcH In support of its petition, Petitioner submitted the following documents, among others: a) 2006 Annual Income Tax Return received by Land Bank of the Philippines; b) 2006 Audited Financial Statement; and c) Minutes of Meeting dated August 4, 2006. aCSDIc Petitioner further alleges that it has no intention to violate the law and henceforth, commits to immediately pay the penalties due and religiously comply with the SEC reportorial requirements. It also paid the penalty of Five Thousand and Seventy-Five Pesos (Php5,075.00), the amount assessed by the SEC-Davao Extension Office under O.R. No. 5475303 dated September 6, 2007. WHEREFORE, premises considered, the Order of Revocation dated July 8, 2003 of Davao City Muslim Association, Inc. is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD) for implementation and attachment to the corporate records of Petitioner on file with the Commission. The Economic Research and Information Department (ERID) is hereby directed to delete the name of Petitioner from the List of Revoked Corporations immediately upon receipt of this Order.
