July 2, 2008 SEC EN BANC CASE NO. 09-07-0190 IN THE MATTER OF PUTING BATO FARMERS AND SETTLERS ASSOCIATION, INC ., petitioner. RESOLUTION For consideration is the Petition to Set Aside Order of Revocation of the Certificate of Registration of petitioner filed on September 4, 2007. Petitioner, a non-stock corporation with office address at Sitio Pandayan, Barangay Inarawan, Antipolo City was represented in the instant petition by Jesus M. Alforte, the corporation's president. aSTAIH On September 29, 2003, petitioner's Certificate of Registration No. 131566 was revoked pursuant to the Order of Revocation dated August 20, 2003 for non-compliance with the Commission's reportorial requirements. Said Order was published in a newspaper of general circulation on August 28, 2003. In an Order dated October 3, 2007, the Commission directed petitioner to pay the assessed penalty of Ten Thousand Pesos (P10,000.00) and to comply with its undertaking dated September 11, 2007 to submit its Income Tax Return within fifteen (15) days from receipt of the Order. The order was personally served on Mr. Alforte on October 17, 2007. Despite receipt of said order, petitioner failed to comply therewith within the prescribed period. WHEREFORE, premises considered, the instant petition is hereby DISMISSED without prejudice on the ground of failure to comply with the Order of the Commission directing the payment of penalty and submission of a required document.
