FOR: LIFTING OF ORDER OF REVOCATION O R D E R Petitioner is a non-stock corporation registered with the Commission on 27 December 1993 primarily to establish, operate, maintain and manage a school or schools for tertiary education. Its principal office is in Alimanao Hills, Penablanca, Cagayan. On 3 November 2003, petitioner's Certificate of Registration No. AN093-005315 was revoked for non-compliance with the Commission's reportorial requirements, pursuant to the Order of Revocation dated 30 September 2003 which was published in a newspaper of general circulation on 4 October 2003. Petitioner now prays for the lifting of the said Order of Revocation based on the following grounds: 1. it has been in operation since its initial registration up to the present and intends to continue its operation under its registered name; 2. it has been a recipient of numerous awards and certificates of appreciation/recognition from the Department of Education (DepEd), Commission on Higher Education (CHED), Philippine Orthopedic Center and UP-PGH, including a certificate of authority to operate a Ladderized Education Program issued by the CHED; and 3. it has 6,096 students enrolled in the different courses offered, 1,341 of whom are enjoying the benefits of the school's scholarship program, and employs a total of 235 employees who depend upon the existence of the school for their wages. In support of its Petition, petitioner submitted as proof of its continued operation: 1. Annual Income Tax Return for the fiscal year ending 31 May 2007; 2. Official Receipts issued by petitioner in 2006 for tuition fees of students; 3. Certificate of Appreciation issued on 29 May 2007 by Dr. Virginia P. Resurreccion, Director IV of the CHED, for petitioner's extension of support to Institutional Monitoring and Evaluation for Quality Assurance (IQuAME); 4. Certificate of Appreciation issued on 20 November 2006 by Mario L. Ramirez, Director IV of the DepEd, to petitioner for being one of the pillar-model private educational institutions in Region 2; 5. Certificate of Authority issued by the CHED on 28 May 2007 for petitioner to operate a Ladderized Education Program; 6. Certificate of Recognition issued by the Philippine Orthopedic Center on 18 November 2006; 7. Certification issued by UP-PGH on 17 November 2006 stating that petitioner has been consistently performing in the field of Radiologic Technology in the performance of their students undergoing Internship Training Program for the past four years; 8. Award for Educational Benefits dated 7 June 2007 from the Philippine Veterans Affairs Office; 9. Letters to petitioner's Registrar sent by the Provincial Scholarship Board on 9 February 2004 and in 9 July 2007; 10. Letter to petitioner's Registrar sent by the Provincial Office of the National Commission on Indigenous Peoples in June 2006 regarding request for educational assistance; 11. Contracts of Affiliation with Jose Reyes Memorial Medical Center, People's Emergency Hospital, Municipal Health Office, and National Health Center for Mental Health; and 12. Certified true copies of the List for Scholarship Grants and Discounts and List of Faculty Members and Personnel for AY 2007-2008. EcTCAD Petitioner alleges that it intends to continue its operations as evidenced by its submission of its most recent General Information Sheet and Financial Statements. It further alleges that it has no intention to violate the law and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. It has also paid in full the total amount of penalty of Seventy-Two Thousand Two Hundred Fifty Pesos (Php72,250.00) as assessed by the Law and Regulation Division (LRD) of the Company Registration and Monitoring Department (CRMD) and evidenced by Official Receipt Nos. 0093290 and 0136709. Accordingly, petitioner is hereby directed to amend its Articles of Incorporation and By-Laws within thirty (30) days from date of receipt hereof to reflect the increase in the number of trustees and the changes in the date of annual membership meeting and the Fiscal Year Ending. Failure on the part of petitioner to comply with this directive shall cause the recall of the instant Order. WHEREFORE, premises considered, the Order of the Commission dated 30 September 2003 revoking the Certificate of Registration of MEDICAL COLLEGES OF NORTHERN PHILIPPINES, INC. is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD) and the Economic Research and Information Department (ERID) of this Commission for their appropriate action.
