May 12, 2008 SEC EN BANC CASE NO. 06-07-0097 IN THE MATTER OF SURE FIRE SECURITY AGENCY AND ALLIED SERVICES, INC. (SEC REG. NO. E199700579) , petitioner. FOR: SETTING ASIDE OF ORDER OF REVOCATION O R D E R Petitioner Sure Fire Security Agency and Allied Services, Inc. ("Petitioner" for brevity) is a stock corporation with principal office at Cor. Avancena and San Mauricio Streets, Molo, Iloilo City, duly registered with the Commission on 21 July 1997 under SEC Registration No. E199700579. It was established to engage in security agency and allied services. On 15 March 2004, Petitioner's Certificate of Registration was revoked pursuant to the Order of Revocation dated 10 February 2004 for non-compliance with the Commission's reportorial requirements. Said Order was published in a newspaper of general circulation on February 14, 2004. Petitioner now prays for the lifting of the said Order of Revocation based on the following grounds: (1) the corporate officers were not aware of the SEC reportorial requirements; and (2) The corporation is in continuous operation. As proof of its continuous operation, Petitioner submitted the following documents: a) 2006 Private Security Agency Regular License to Operate No. PSA-600052-2006 dated 23 January 2006 which expires on February 28, 2008; ScaATD b) 2007 List of clients; c) 2006 Income Tax Return; and d) 2007 business permit issued by the Office of the Mayor of Iloilo City. Petitioner further alleges that it has no intention to violate the law and henceforth, commits to immediately pay the penalties due and religiously comply with the SEC reportorial requirements. 2008sec1strel On 19 June 2007, it also paid the penalty of Nineteen Thousand Pesos (Php19,000.00), the amount assessed by the SEC Iloilo Extension Office, under O.R. No. 5472620. WHEREFORE, premises considered, the Order of the Commission dated 10 February 2004 revoking the Certificate of registration of Sure Fire Security Agency and Allied Services, Inc. is hereby SET ASIDE. Petitioner is likewise directed to submit the 2008 Mayor's Permit and the Private Security Agency Regular License to Operate within thirty (30) days from date of receipt of this Order. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD) and the SEC Iloilo Extension Office (SEC-IEO) for implementation and attachment to the corporate records of petitioner on file with the Commission and the mentioned extension office. The Economic Research and Information Department (ERID), is hereby directed to delete the name of Petitioner from the List of Revoked Corporations immediately upon receipt of this Order. SO ORDERED.
