January 14, 2008 SEC EN BANC CASE NO. 06-07-0095 IN THE MATTER OF CAGAYAN DE ORO FIRST ASSEMBLY OF GOD CHURCH, INC. (SEC REG. NO. HN094-00188) , petitioner . FOR: LIFTING OF ORDER OF REVOCATION ORDER Petitioner is a non-stock corporation registered with the Commission on 16 August 1994 as a religious organization. On 3 November 2003, petitioner's Certificate of Registration No. HN094-00188 was revoked for non-compliance with the Commission's reportorial requirements, pursuant to the Order of Revocation dated 30 September 2003 which was published in a newspaper of general circulation on 4 October 2003. Petitioner now prays for the lifting of the said Order of Revocation based on the following grounds: 1. its failure to submit its financial statements on time as required by the rules was due to excusable negligence, i.e. the personnel in charge of the preparation and submission of the same overlooked the timetable because of among others, extra ordinary volume of work in some equally important concerns of the church; and 2. it has not received any notice of revocation from the Commission prior to its revocation. In support of its Petition, petitioner submitted as proof of its continued operation: 1. 2006 Income Tax Return; and 2. Official Receipts it issued for 2006. Petitioner alleges that it intends to continue its operations as evidenced by its submission of its most recent General Information Sheet and Financial Statements. It further alleges that it has no intention to violate the law and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. It has also paid in full the total amount of penalty of Thirty-Three Thousand Pesos (Php33,000.00) as assessed by the Commission's Cagayan de Oro Extension Office and evidenced by Official Receipt No. 5458014. WHEREFORE, petitioner's allegation of lack of notice of revocation is without merit considering that the Order of this Commission dated 30 September 2003 was published in a newspaper of general circulation on 4 October 2003. However, finding the documents submitted to support the instant petition of Cagayan de Oro First Assembly of God Church, Inc. to be sufficient the aforesaid Order is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD), the Economic Research and Information Department (ERID) and the Cagayan de Oro Extension Office (SEC-CDO) of this Commission for their appropriate action.
