November 28, 2008 SEC EN BANC CASE NO. 05-08-0457 IN THE MATTER OF PHILIPPINE JUNIOR BOWLERS ASSOCIATION, INC. SEC REGISTRATION NO. 0000098413 FOR : Setting Aside the Order of Revocation of the Certificate of Registration O R D E R Petitioner, PHILIPPINE JUNIOR BOWLERS ASSOCIATION, INC., is a non-stock corporation registered with the Commission on 8 April 1981, under SEC Registration No. 0000098413, with principal office address at 9420 Magallanes St., Guadalupe Nuevo, Makati, Metro Manila, organized to conduct, regulate, control and supervise tenpin bowling tournaments of young bowlers with the ultimate objective of developing their skill and competence, as stated in its Articles of Incorporation. IDcAHT On 11 August 2003, its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated 8 July 2003, published on 11 July 2003 in the Philippine Daily Inquirer, for non-filing of reports. Petitioner now prays for the setting aside of the Order of Revocation dated 8 July 2003, on the following grounds: 1. that it will help in the training of Filipino bowlers in international competition by organizing programs which will improve their level of performance thereby ensuring that our country is well represented in international competition; 1 2. that it has no intention to violate the law and any SEC rules and regulations; 3. that it shall henceforth submit reportorial requirements religiously; and 4. that it intends to continue its registration with the Commission. In support of its Petition, Petitioner submitted the following documents: * 1. Photocopy of Petitioner's 2008 Mayor's Permit, Makati City; 2. Photocopy of Petitioners 2008 Sanitary Permit, Makati City; 3. Certification dated April 17, 2008 by the Philippine Olympic Committee that Petitioner is a recognized junior division of the Philippine Bowling Congress, which is a regular member of the Philippine Olympic Committee; and 4. Trustees' Certificate dated January 25, 2008 certifying that at a meeting of the members and the Board of Trustees' held on January 25, 2008, in Makati City, at which a quorum was present, the resolution allowing the filing of the Petition to Set Aside Order of Revocation was approved; Petitioner submitted its 2008 General Information Sheet and 2007 Financial Statements to prove its intention to continue its registration with the Commission. It also commits to immediately pay the fines as due. DaScAI On 13 May 2008, Petitioner paid the fine of Php13,000.00, under Official Receipt No. 5506778, for non/late filing/registration of the following, on the years indicated hereunder: Requirements Not Filed Filed Late General Information Sheet 1996-2007 2008 Financial Statements 1996-2006 2007 Membership Book Registered late WHEREFORE, finding the submitted documents sufficient to establish Petitioner's intent to continue as a juridical entity, the Order of the Commission dated 8 July 2003, revoking the Certificate of Registration of the PHILIPPINE JUNIOR BOWLERS ASSOCIATION, INC., is hereby SET ASIDE.
