FOR: SETTING ASIDE THE ORDER OF REVOCATION O R D E R Petitioner, CATANDUANES ANAHAW PRODUCERS ASSOCIATION, INC., is a non-stock corporation registered with the Commission on 28 June 1994, under SEC Registration No. AN094-002433, with principal office at Virac, Catanduanes. Its purposes, as stated in its Articles of Incorporation, are: to promote and develop industrial plantations in the Philippines particularly in the Province of Catanduanes to ensure adequate supply of anahaw, timber and other forest products through effective protection and sustainable management of our natural forests, etc. DAESTI On 03 November 2003, its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated 30 September 2003, published on 04 October 2003 in the Philippine Daily Inquirer, for non-filing of reports. Petitioner now prays for the setting aside of the said Order of Revocation dated 30 September 2003, on the ground that it has pending projects on seedling production and tree planting and may not materialize if the Order of Revocation is not set aside and may thereby prejudice the government's reforestation project. In support of its Petition, Petitioner submitted the following documents: 1 1. Photocopy of the 2008 Business Permit issued by the Office of the Municipal Mayor of Catanduanes on 14 May 2008; 2. Photocopies of the 2007 and 2006 Annual Income Tax Return filed with the Bureau of Internal Revenue on 07 May 2008; 3. Photocopy of the Minutes of the Special Meeting of the Board of Trustees held on 31 March 2008; 4. Trustees' Certificate dated 25 March 2008, certifying that at the joint meeting of the members and the Board of Trustees, held on 24 March 2008, at Virac, Catanduanes, at which a quorum was present, the resolution allowing the filing of Petition to Set Aside Order of Revocation was approved unanimously by the members and the Board of trustees; 5. Photocopy of the 2007 Business Permit issued by the Office of the Municipal Mayor of Catanduanes on 06 March 2007; 6. Photocopy of the Memorandum of Agreement among the Petitioner, the Technology Resource Center, and Hon. Joseph A. Santiago, wherein Petitioner was endorsed to implement the livelihood and development projects in Catanduanes. Petitioner submitted its 2008 General Information Sheet and 2007 Financial Statements to prove its intention to continue its registration with the Commission. It also manifested that it has no intention to violate the law and that it commits to immediately pay the fines due. SATDEI On 13 May 2008, Petitioner paid the fine of Php11,000.00, the amount assessed by the Law and Regulation Division of the Company Registration and Monitoring Department (CRMD), under Official Receipt No. 5507098 for non/late filing of the following: NOTED DEFICIENCIES YEARS COVERED REQUIREMENTS NOT FILED FILED LATE General Information Sheet 1996-2007 2008 Financial Statements 1996-2005 2006-2007 WHEREFORE, finding the Petition meritorious, the Order of the Commission dated 30 September 2003 revoking the Certificate of Registration of CATANDUANES ANAHAW PRODUCERS, INC., is hereby SET ASIDE. Let a copy of this Order be furnished the Corporate Filing and Records Division of the CRMD for attachment to the corporate records of the Petitioner on file with the Commission. The Economic Research and Information Department is hereby directed to delete the name of the Petitioner from the list of revoked corporations immediately upon receipt of this Order.
