CORPORATION SEC REGISTRATION NO. 178910 FOR : Setting Aside the Order of Revocation of the Certificate of Registration O R D E R Before the Commission is the Petition filed by DONGJIN GAEBAL PHILS. CORPORATION to Set Aside the Order of Revocation dated 03 April 2007. aDcHIS Review of the submitted documents reveals that Petitioner has not paid the assessed fines of Twenty Thousand Five Hundred Pesos (Php20,500.00). An Order dated 19 April 2007 was issued by the Commission directing Petitioner to pay the said fines. The Order was received by Petitioner on 11 May 2007 and Petitioner was given five (5) days from receipt thereof to pay the assessed penalty and was warned that failure of compliance will result to the dismissal of the Petition without prejudice. A copy each of the transmittal letter and the Order are herein attached as Annexes "A" and "A-1", respectively. Petitioner has not complied with the directive. On 15 January 2008 the Commission, in order to give chance for the Petitioner to comply with its directive, issued another Order directing, for the last time, Petitioner to pay the assessed fines. Said Order was returned to the Commission for the reason that the Petitioner has moved out from the address indicated in the submitted Petition and in the 2006 General Information Sheet. Efforts were exerted by the Commission to locate and communicate with the Petitioner but to no avail. From the time the Petition was filed in 03 April 2007 to date, the Commission has not received any action or letter from the Petitioner. It is the obligation of the Petitioner to be vigilant on its right to know the status of its case. In this regard, it is understood that the Petitioner has no interest to pursue the case. WHEREFORE, for failure to comply with the Commission's directive and for lack of interest to pursue the case, the Petition to Set Aside Order of Revocation filed by DONGJIN GAEBAL PHILS.
