May 9, 2008 SEC EN BANC CASE NO. 01-08-0330 IN THE MATTER OF BULACAN MONTESSORI SCHOOL, INC. (SEC REG. NO. AN094-001760) , petitioner . FOR : Setting Aside of the Order of Revocation of Certificate of Registration O R D E R Petitioner Bulacan Montessori School, Inc. is a non-stock corporation registered with the Commission on 05 May 1994 with the following purposes: 1. Instructional To establish school for, offer courses in and conduct instruction on Kindergarten, Primary, Intermediate and Secondary both in academic as well as in vocational, technical through formal, non-formal and informal teaching-learning situations; cAIDEa 2. Research To conduct both basic and applied research in all fields within the competence and expertise of its faculty and studentry[,] to extend and advance the frontiers of knowledge and to enrich its instructional reservoir; and 3. Extension To conduct community outreach programs or extension services to share the results of its researches and the exper[ie]nces, competencies and skills of its instructional staff and student body to the people and their community to help contribute in bringing about a better quality of life not only of urban but more importantly in the rural communities. 1 Petitioner's business office address is at 253 Sta. Ana, Bulacan, Bulacan. On 03 November 2003, Petitioner's Certificate of Registration No. AN094-001760 was revoked pursuant to the Order dated 30 September 2003 for non-compliance with the Commission's reportorial requirements. Said Order was published in a newspaper of general circulation on 04 October 2003. Petitioner now prays for the setting aside of the said Order of Revocation based on the ground that "due to the death of its previous President[,] who was knowledgeable of all [its] corporate affairs, the present officers only learned of the faux paus recently." 2 In support of its Petition, Petitioner submitted its 2007 General Information Sheet (GIS) and 2007 Audited Financial Statements. Petitioner also submitted, as proof of its continued operation, copies of the following documents: a) Government Recognition for the Pre-Elementary Course (No. E-039, s. 1995) given on 22 November 1995 by Esperanza M. Orlina, Regional Director DECS, Region III; b) Government Recognition for the Grades I-VI of the Elementary Course (No. E-049, s. 1998) given on 23 September 1998 by Stephen N. Capuyan, Regional Director DECS, Region III; c) Government Permit "to operate First & Second Year Levels of the Secondary Course" (No. S-054, s. 2006) given on 23 October 2006 by Dinah F. Mindo, Director IV, Department of Education, Region III; and d) Certification dated 19 September 2007 issued by Edna Santos-Zerrudo, Schools Division Superintendent (Department of Education, Division of Bulacan), stating that "[petitioner] is on (sic) operation up to the present School Year 2007-2008." Petitioner further alleges that it has no intention to violate the law and any SEC rules and regulations and henceforth, commits to comply with the rules and regulations of the Commission regarding the submission of reports. It has also paid in full the penalty amounting to Forty-Eight Thousand Pesos (Php48,000.00) as evidenced by Official Receipt No. 0103815 dated January 15, 2008. CDESIA WHEREFORE, premises considered, the Order of the Commission dated 30 September 2003 revoking the Certificate of Registration of Bulacan Montessori School, Inc. is hereby SET ASIDE. Let a copy of this Order be furnished the Company Registration and Monitoring Department (CRMD) and the Economic Research and Information Department (ERID) of this Commission for their appropriate action. cSCTEH SO ORDERED.
