2021 ENFORCEMENT AND INVESTOR PROTECTION DEPARTMENT TO : Securities Brokers and Dealers, Investment Houses, Underwriters of Securities, Government Securities Eligible Dealers, Investment Companies/Mutual Fund, Investment Company Advisers, Mutual Fund Distributors, REIT Fund Managers, Financing Companies and Lending Companies SUBJECT : Anti-Money Laundering and Combating the Financing of Terrorism (AML/CFT) Inherent Risk Assessment Data Form (AIRDF) NOTICE Pursuant to Section 5.1 of Rule 7 of the 2018 Implementing Rules and Regulations of Republic Act No. 9160 or the Anti-Money Laundering Act of 2001, as amended and SEC Memorandum Circular No. 26, Series 2020, a risk-based AML/CFT supervision shall be implemented to check compliance by covered persons with AML/CFT requirements. A risk-based approach to Anti-Money Laundering/Combating the Financing of Terrorism (AML/CFT) would ensure that the appropriate measures commensurate to the assessed risks are taken in order to mitigate them effectively. To assess the Money Laundering/Terrorism Financing (ML/TF) risks to which covered persons are exposed and understand their AML/CFT risk profile, there is need for information on a range of factors that are inherent to their operations. Accordingly, all covered persons are directed to accomplish the AML/CFT Inherent Risk Assessment Data Form (AIRDF) for data covering the period year 2020 and submit the same on or before 15 October 2021 . The AIRDF is a report on data pertinent to a covered person's operations, to wit: a. Nature of products and services types of products and services being offered. b. Total size and value of the products and services volume and value of transactions. c. Customer profile type, profile, geographical location and/or behavior of customers that use/avail of the covered persons' products and services. d. Delivery channels channels used to deliver products and services and the degree of verification performed by the covered person as part of CDD. e. Financial channels channels used to collect payment and disburse funds. f. Geographical location information involving the country or geographic area of operations, origin, residence or nationality/citizenship of the customers and counter parties.
