August 11, 2022 ENFORCEMENT AND INVESTOR PROTECTION DEPARTMENT SEC ADVISORY This Advisory is prompted by reports and information gathered by the Commission that a group of persons representing themselves as employees of the Philippine Stock Exchange (PSE), are enticing the public through social media platforms to invest in the stock market via " pse.tavfar.com ." Based on the information received, the offering of investment particularly stock trading is through the following scheme: The perpetrator communicates with a potential investor/victim via WhatsApp and Telegram applications to introduce the procedures of the investment scheme, elicit personal information, and ask the potential investor/victim regarding his knowledge on stock trading. The perpetrator offers the following investments: o Daily Stock a minimum investment of Php1,000.00, with a profit range of 30% to 70% covering a trading period of 5 to 10 minutes of trading . The profits can be withdrawn immediately after the trade. The investor will do the trading process while being guided by a so called "expert broker." o Long Term Stock a minimum investment of Php50,000.00 to Php100,000.00, with a profit range of 50% to 70% dividends payout per day . The Dividends will be received after seven days, which may be withdrawn twice a month. The investor is not required to personally trade rather a so called "expert broker" will do the trading. Potential investor/victim is asked to register by creating an account in the facility provided at "pse.tavfar.com." After a successful registration process, the scammer will then ask the investor to deposit to the perpetrator's GCash account of at least Php1,000.00 as initial investment minimum. The perpetrator deceives the public by making it appear that "pse.tavfar.com" is the official webpage of the PSE and uses the same to induce the public in investing in the "stock market." Such deceit appears to constitute fraud in violation of Section 26 of the Securities Regulation Code (SRC) as its activity relates to the buying and selling of securities. In view thereof, the public is hereby advised NOT TO ENGAGE IN ANY ACTIVITY BEING OFFERED at "pse.tavfar.com" or through any person or entities related thereat . Those who act as salesmen, brokers, dealers or agents of " pse.tavfar.com ," in selling or convincing people to engage in the investment scheme being offered by the said entity including soliciting investments or recruiting investors or engaging in stock market trading through the said webpage may be held criminally liable under Section 28 of the SRC and penalized with a maximum fine of Five Million Pesos (Php5,000,000.00) or imprisonment of Twenty One (21) years or both pursuant to Section 73 of the SRC ( SEC vs. Oudine Santos , G.R. No. 195542, 19 March 2014).
