February 23, 2024 ENFORCEMENT AND INVESTOR PROTECTION DEPARTMENT SEC ADVISORY This is to inform the public that JVP TRADING EXPERT INVESTMENT is NOT AUTHORIZED TO SOLICIT INVESTMENTS FROM THE PUBLIC. ATICcS This Advisory is prompted by reports received and information gathered by the Commission that individuals or group of persons, headed by a certain JUMAR VELASQUEZ PUZON (known as PUZON JUMAR in Facebook) , are enticing the public, through social media platforms, to invest in JVP TRADING EXPERT INVESTMENT . As posted on its Facebook Page, JVP TRADING EXPERT INVESTMENT is allegedly engaged in the poultry farming business and claims to earn from different sources of funds such as a) 60% for Poultry Farm; b) 10% for Lending; c) 10% for Paying based; and d) 20% for Backup Funds. The investment opportunity being offered by JVP TRADING EXPERT INVESTMENT is a form of securities as the elements of investment contract are present in its investment offering. Moreover, the public are enticed to invest with an amount ranging from Php100.00 and above, where his/her investment will earn through the followings ways: 1. COMPLAN J or 100% monthly profit where an investor-member is entitled to receive a daily payout or equivalent to a total of 100% per month. 2. COMPLAN V or 200% monthly profit where an investor-member is entitled to receive a payout every five (5) days or equivalent to a total of 200% per month. ETHIDa 3. COMPLAN P or 300% monthly gain where an investor-member is entitled to receive a payout after one (1) month or equivalent to a total of 300% return on investment . It must be noted that while JVP TRADING EXPERT INVESTMENT is not registered as a corporation, the aforementioned schemes of JVP TRADING EXPERT INVESTMENT vis--vis JUMAR VELASQUEZ PUZON seems to be fraudulent as it is involved in the solicitation, offering, and/or selling of unregistered securities to the public in violation of Sections 8 and 26 of the Securities Regulation Code. Further, the Financial Products and Services Consumer Protection Act (FCPA) also prohibits investment fraud which is defined under the law as any form of deceptive solicitation of investments from the public which includes Ponzi schemes and such other schemes involving the promise or offer of profits or returns sourced from the investments or contributions made by the investors themselves and the offering or selling of investment schemes to the public without a license. TIADCc Accordingly, the Commission warns all unscrupulous individuals and/or entities that strict penalties are imposed for violations of the Securities Regulation Code and the Financial Products and Services Consumer Protection Act (FCPA)and such other laws, rules and regulations enforced by the Commission . Those who act as salesmen, brokers, dealers or agents of JVP TRADING EXPERT INVESTMENT vis--vis JUMAR VELASQUEZ PUZON in selling or convincing people to invest in what appears to be an investment scheme being offered by said entity including solicitations and recruitment through the internet may be prosecuted and held criminally liable under Section 28 of the SRC and Section 11 of the FCPA and both penalized with a maximum fine of Five Million pesos (Php5,000,000.00) or penalty of Twenty-one (21) years of imprisonment or both pursuant to Section 73 of the SRC. In view thereof, the public is advised NOT TO INVEST or STOP INVESTING in any investment scheme being offered by JVP TRADING EXPERT INVESTMENT vis--vis JUMAR VELASQUEZ PUZON as well as in other entities having the same or similar schemes and to exercise caution in dealing with any individuals or group of persons soliciting investments or recruiting investors for and on behalf of JVP TRADING EXPERT INVESTMENT vis--vis JUMAR VELASQUEZ PUZON .
