August 23, 2021 ENFORCEMENT AND INVESTOR PROTECTION DEPARTMENT SEC ADVISORY The Commission has received information that MONEY GAME HUB/MGH TRADING OPC ("MGH") is engaged in UNAUTHORIZED investment-taking activities. MONEY GAME HUB/MGH TRADING OPC is allegedly a perfume-distribution marketing company and is headed by ALEXANDER LIBRES SALVADOR who entices the public to join the company and invest a minimum of Five Hundred Pesos (Php500.00) and promises seven times (7X) return on investment for a period of 40 days . DIRECT REFERRAL BONUS - CHALK PLAYER 20% - DIME PLAYER 25% - SHARP PLAYER 30% - SHARK PLAYER 35%; and - WHALE PLAYER 50% INDIRECT REFERRAL BONUS of 1% to every up-line member, chained all the way up to infinity (CEO of company). ENCASHMENT BONUS 1% of cash taken from every cash withdrawal and given to the next up-line member. MONEY SPIN (A casino feature/game of chance) For joining members: P5,000 = 1 ticket, P20,000 = 3 tickets, P50,000 = 5 tickets. As the aforementioned schemes involve the sale of securities to the public, the Securities Regulation Code (SRC) requires that these securities are duly registered and that the concerned corporation and/or its agents have appropriate registration and/or license to sell such securities to the public pursuant to Sections 8 and 28 of the SRC. The public is hereby informed that MONEY GAME HUB is not registered as a corporation and partnership. However, MGH TRADING OPC is registered with the Commission as a One Person Corporation. Nonetheless, both MONEY GAME HUB/MGH TRADING OPC are not authorized to solicit investments from the public as they did not secure prior registration and/or license to solicit investments from the Commission as prescribed under Section 8 of the Securities and Exchange Commission. The public is reminded that the issuance of a Certificate of Incorporation only grants the said entity juridical personality but does not constitute an authority or license for the corporation to engage in activities such as solicitation of investments, issuance of investments contracts, offering and sale of investment contracts that require a secondary license . Consequently, those who act as salesmen, brokers, dealers or agents of MONEY GAME HUB/MGH TRADING OPC in selling or convincing people to invest in their investment schemes including solicitations or recruitment through the internet may likewise be prosecuted and held criminally liable under Section 28 of the SRC and penalized with a maximum fine of Five Million Pesos (Php5,000,000.00) or maximum penalty of Twenty-One (21) years imprisonment or both pursuant to Section 73 of the SRC. Also, those who invite or recruit others to join or invest in such venture or offer investment contracts or securities to the public may incur criminal liability, or otherwise be sanctioned or penalized accordingly as held by the Supreme Court in the case of Securities and Exchange Commission vs. Oudine Santos (G.R. No. 195542, 19 March 2014). In view thereof, the public is hereby advised to STOP INVESTING in the investment schemes being offered by any individual or group or persons allegedly acting for or on behalf of MONEY GAME HUB/MGH TRADING OPC . Furthermore, the names of all those involved will be reported to the Bureau of Internal Revenue (BIR) so that the appropriate penalties and/or taxes be correspondingly assessed.
