July 13, 2021 ENFORCEMENT AND INVESTOR PROTECTION DEPARTMENT SEC ADVISORY The Securities and Exchange Commission has received information that individuals or group of individuals representing ASIAWORKS DIGITAL MARKETING SERVICES ("ASIAWORKS") under Ivan Henry Prieto Enrijo are enticing the public to invest their money in the said entity with the promise of monetary rewards or profits. Per investigation, the company (website: https://www.asiaworksco.com ) is enticing the public to invest with a guaranteed 10% daily revenue in 30 days per subscription or triple your money after 30 days . As posted online, Asiaworks represents: "Asiaworks is an online platform that offers subscription that provides a manageable, smooth and hassle free trading. Founded by Mr. Ivan Enrijo who is the president of the company. Asiaworks provides its subscribers professional trading signals from multiple sources daily from our top traders via email/FB private group. Asiaworks also gives its subscribers a 10% daily revenue within 30 days from their subscription amount." a. The COMPLAN: b. The Marketing Plan: c. How to Subscribe: STEP 1 The investor should create an account by signing up in their website ( www.asiaworks.com ) or in the referral link given by the person who introduced ASIAWORKS . STEP 2 Add credits The investor should go to the ADD CREDIT section and get the details of the depository account where he/she prefers to send the payment then proceed to the deposit form or contact any of the accredited E-Tellers of the company for assistance. Minimum Php500 worth of credit load is needed. Wait 1-2 hours to verify and approve the add credit requests. STEP 3 Pay credit load The investor should pay the amount of credit load requested and send the necessary details as proof of payment (reference number, amount deposited, name of payment sender, exact date and time of deposit). STEP 4 Subscribe Once the payment is approved, the investor can proceed to the Subscribe section then enter the amount to be invested and click subscribe. STEP 5 Check subscription entry An email confirming the subscription will be sent to the investor. To check if the investment is activated, the investor should click "Entries." d. Other Ways to Earn: The above-described scheme offered by Ivan Henry Prieto Enrijo is clearly in the nature of solicitation of investments from the public in the form of investment contract. Simply, the scheme is "subscribe, wait, and earn." Since the said scheme involves the sale of securities to the public, the Securities Regulation Code (SRC) requires that these securities are duly registered with the Commission and that the concerned corporation and/or its agents have appropriate registration and/or license to sell such securities to the public pursuant to Sections 8.1 and 28.1 of the SRC. ASIAWORKS DIGITAL MARKETING SERVICES (ASIAWORKS) is not registered with the Commission either as a corporation or as a partnership. However, ASIAWORKS has been issued a Certificate of Business Name Registration on 29 April 2021 by the Department of Trade and Industry (DTI) with Business Name No. 2875993 under the name of its Founder/President, IVAN HENRY PRIETO ENRIJO . Nonetheless, ASIAWORKS DIGITAL MARKETING SERVICES (ASIAWORKS) is not authorized to solicit investments from the public as it did not secure prior registration and/or license to solicit investments from the Commission as prescribed under Section 8 of the Securities Regulation Code. Accordingly, the Commission warns all unscrupulous individuals and/or entities that strict penalties are imposed for violations of the Securities Regulation Code, the Revised Corporation Code and such other laws, rules and regulations enforced by the Commission . Hence, those who act as salesmen, brokers, dealers or agents or claim to act as such of ASIAWORKS DIGITAL MARKETING SERVICES in selling or convincing people to invest in the investment scheme being offered by said entity including solicitations and recruitment through the internet may be prosecuted and held criminally liable under Section 28 of the SRC and penalized with a maximum fine of Five Million pesos (Php5,000,000.00) or penalty of Twenty-one (21) years of imprisonment or both pursuant to Section 73 of the SRC. Also, those who invite or recruit others to join or invest in such venture or offer investment contracts or securities to the public may incur criminal liability, or otherwise be sanctioned or penalized accordingly as held by the Supreme Court in the case of Securities and Exchange Commission vs. Oudine Santos (G.R. No. 195542, 19 March 2014) . Further, the names of all those involved will be reported to the Bureau of Internal Revenue (BIR) so that the appropriate penalties and/or taxes be correspondingly assessed. In view thereof, the public is advised NOT TO INVEST or STOP INVESTING in any investment scheme being offered by ASIAWORKS DIGITAL MARKETING SERVICES and exercise caution in dealing with any individuals or group of persons soliciting investments or recruiting investors for and on behalf of ASIAWORKS DIGITAL MARKETING SERVICES .
