May 27, 2021 ENFORCEMENT AND INVESTOR PROTECTION DEPARTMENT SEC ADVISORY Based on numerous reports and information gathered by the Commission, the entity operating under the name FRANCIS LEO MARCOS FAMILY CLUB, INCORPORATED by FRANCIS LEO A. MARCOS or NORMAN A. MANGUSIN is falsely claiming to be registered as a corporation with the Commission and is soliciting donations from the public without any prior registration, license and/or accreditation from the Department of Social Welfare and Development (DSWD). To wit : Apparently, FRANCIS LEO A. MARCOS with the assistance of YHAMA TAN or JONCHO TAN , ACEY GUTIERREZ , LUANNE PE ANO , MARY "VICTORIA" SANVICTORES , ALYSSA DEE, EDUVEGES "DONG" BATALAN , MARK JOHN "MAC MAC" PABLO , ROMMEL of LEMMOR CREATION , and others, pleads donations from the public, mostly from our Overseas Filipino Workers (OFWs), through the FRANCIS LEO MARCOS FAMILY CLUB, INCORPORATED for his supposed humanitarian activities. However, based on our records, FRANCIS LEO MARCOS FAMILY CLUB, INCORPORATED is NOT REGISTERED WITH THE COMMISSION . Hence, IT CANNOT ACT OR OPERATE AS A CORPORATION IN ACCORDANCE WITH THE REVISED CORPORATION CODE OF THE PHILIPPINES which imposes strict penalties for nonconformity and/or violations. In addition, the Commission found that FRANCIS LEO MARCOS FAMILY CLUB, INCORPORATED is also NON-COMPLIANT with the "REVISED OMNIBUS RULES AND REGULATIONS ON PUBLIC SOLICITATION" and the "Solicitation Permit Law of the Philippines" (Presidential Decree No. 1564) which aims to obviate illegal fund drives by promoting transparency and accountability of persons, corporations, organizations and associations to ensure the efficient management of funds solicited from the public. Consequently, the lack of said registration, license and/or accreditation from both the Commission and the DSWD make FRANCIS LEO MARCOS FAMILY CLUB, INCORPORATED dubious and susceptible of financial abuse and misuse. Thus, the Commission warns the public to be cautious of FRANCIS LEO MARCOS and his FRANCIS LEO MARCOS FAMILY CLUB, INCORPORATED and/or in dealing with any individuals or group of persons acting or soliciting donations for or on behalf of FRANCIS LEO MARCOS and/or his FRANCIS LEO MARCOS FAMILY CLUB, INCORPORATED . Likewise, the public is reminded to always exercise due diligence before giving to charity in order to assure that all their contributions count and will be used accordingly as purportedly intended because some of which may be scams being manipulated by unscrupulous individuals and/or entities posing as legitimate entities, non-profit organizations and/or foundations similar to the FRANCIS LEO MARCOS FAMILY CLUB, INCORPORATED which appears to be preying on the public by taking advantage of the current pandemic for their own benefit.
