July 16, 2020 ENFORCEMENT AND INVESTOR PROTECTION DEPARTMENT SEC ADVISORY Based on the information gathered by the Commission, a number of individuals or group of persons claiming to represent CAPTCHALINKZ DIGITAL MARKETING SERVICES headed by Jake D. Calinog/Jake D. Calino/Calinog JC Jake, are enticing the public to invest their money in said entity. HTcADC As posted online, CAPTCHALINKZ DIGITAL MARKETING SERVICES is offering investments to the public by paying Php499.00 per account. Upon joining, a member is automatically given forty (40) captchas that must be solved in four (4) days [ten (10) captchas per day] that entitles such member to earn Php10.00 for every captcha solved or for a total of Php400.00 or a return of 80% in 4 days . Below are the other ways to earn: 1. Royalty Captcha A member shall be entitled to earn Php2.00, Php1.00, and Php.50 for his/her first (1st), second (2nd), and third (3rd) level recruits' captcha typing jobs. 2. Direct Referral A member shall earn an unlimited direct referral commission whenever he/she recruits a new member amounting to Php20.00 per recruit plus ten (10) token. Note: For every token is equivalent to a captcha typing job. 3. Indirect Referral A member shall earn Php10.00 for indirect recruits up to the 3rd level, and Php5.00 for the 4th to 5th level. 4. Pairing Bonus A member shall earn Php50.00 for every paired member under his/her structure. As the above described schemes involved the offer and sale of securities to the public, the Securities Regulation Code (SRC) requires that these securities are duly registered and that the concerned corporation and/or its agents have appropriate registration and/or license to sell such securities to the public pursuant to Section 8 of the SRC. The records of the Commission show that CAPTCHALINKZ DIGITAL MARKETING SERVICES is not registered with the Commission neither as a corporation nor as a partnership. Further, it is NOT AUTHORIZED to solicit investments from the public since it has not secured prior registration and/or license from the Commission as prescribed under Sections 8 and 28 of the Securities Regulation Code. Hence, those who act as salesmen, brokers, dealers or agents or claim to act as such for CAPTCHALINKZ DIGITAL MARKETING SERVICES in selling or convincing people to invest in the investment scheme being offered by said entity including solicitations and recruitment through the internet may be prosecuted and held criminally liable under Section 28 of the SRC and penalized with a maximum fine of Five Million pesos (P5,000,000.00) or penalty of Twenty-one (21) years of imprisonment or both pursuant to Section 73 of the SRC. Also, those who invite or recruit others to join or invest in such venture or offer investment contracts or securities to the public may incur criminal liability, or otherwise be sanctioned or penalized accordingly as held by the Supreme Court in the case of Securities and Exchange Commission vs. Oudine Santos (G.R. No. 195542, 19 March 2014).
