A200006907 FOR : Setting Aside the Order of Revocation of the Certificate of Registration O R D E R Petitioner, MALAYBALAY ORGANIC FARM, INC., is a stock corporation registered with the Commission on 28 April 2000, under SEC Registration No. A200006907, with principal office address at 18 N. Domingo Street, Quezon City, engaged in the business of producing, exporting, importing and trading on wholesale of all kinds of agricultural products, as stated in its Articles of Incorporation. DCcIaE On 2 August 2006 its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated 27 June 2006, published on 3 July 2006 in the Philippine Star, for non-filing of reports. Petitioner now prays for the setting aside of the Order of Revocation dated 27 June 2006, on the following grounds: 1. that it was still on its experimental stage in determining whether the soil and climate in Mindanao will suit the standards of fruits sold in the world market; 2. that it has no intention to violate the law and any of the SEC rules and regulations; and 3. that it shall henceforth submit reportorial requirements religiously. In support of its Petition, Petitioner submitted the following documents: * 1. Photocopy of its 2002 Business Permit, City of Malaybalay, Bukidnon; 2. Photocopies of its 2003-2007 Mayor's Permit, Lantapan, Bukidnon; 3. Photocopies of its 2002, 2003, 2004, 2005, 2006 and 2007 Annual Income Tax Returns, received by the BIR on April 21, 2003, June 4, 2004, March 15, 2005, April 17, 2006, April 18, 2007 and April 15, 2008, respectively; and 4. Photocopies of its 2006 Annual Income Tax Return, received by the BIR on March 9, 2007. Petitioner submitted its 2007 General Information Sheet and 2006 Financial Statements to prove its intention to continue its registration with the Commission. It also commits to immediately pay the fines as due. On 20 November 2007, Petitioner paid the fine of Php12,400.00, under Official Receipt No. 0114742, for non/late filing of the following, on the years indicated hereunder: EHDCAI Not Filed Filed Late General Information Sheet 2001-2006 2007 Financial Statements 2001-2002, 2004 and 2005 2003 (ANO) and 2006 Wherefore, finding the submitted documents sufficient to establish Petitioner's operation since 2002 and its intent to continue as a juridical entity, the Order of the Commission dated 27 June 2006, revoking the Certificate of Registration of the MALAYBALAY ORGANIC FARM, INC., is hereby SET ASIDE.
