February 13, 2009 SEC CRMD CASE NO. 08-11-0013 IN THE MATTER OF LADY OF ROSE ACADEMY, INC. SEC REGISTRATION NO. A200014604 FOR : Setting Aside the Order of Revocation of the Certificate of Registration O R D E R Petitioner, LADY OF ROSE ACADEMY, INC. is a non-stock corporation registered with the Commission on 21 September 2000, under SEC Registration No. A200014604, with principal office address at ALBEDA Building, Blk. 10 Lot 16 Rosario Village, Sala, Cabuyao, Laguna, organized to operate a learning center which shall provide courses of study in preparatory, elementary, and secondary levels, as stated in its Articles of Incorporation. AECIaD On 02 August 2006, its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated 27 June 2006, published on 03 July 2006 in the Philippine Star, for non-filing of reports. Petitioner now prays for the setting aside of the said Order of Revocation dated 27 June 2006, on the following grounds: 1. that Petitioner has been in continuous operation from the time it was incorporated; 2. that Petitioner has faculty members and employees relying on it for income; 3. that Petitioner has no intention to violate the law and any SEC rules and regulations; and 4. that Petitioner shall henceforth submit its reports. In support of its Petition, Petitioner submitted the following documents: * 1. Photocopy of Official Receipts on the tuition and other fees, issued by the Petitioner all dated 21 November 2008; 2. Photocopies of 2007 and 2008 Business Permit, Cabuyao, Laguna; 3. Trustees' Certificate dated 05 October 2007, certifying that at the regular meeting of the members and the trustees on 26 September 2007, at which a quorum was present, the resolution allowing the filing of Petition to Set Aside Order of Revocation was approved; 4. Photocopy of Government Recognition issued by the Department of Education (DepEd) dated 26 June 2004 for complete Secondary Course, for school year 2003-2004; 5. Photocopy of Government Recognition issued by the DepEd dated 06 August 2002 for Third and Fourth Curriculum Years for the SY 2003-2004; 6. Photocopy of Government Recognition issued by the DepEd dated 06 August 2002 for First and Second Curriculum Years for the SY 2003-2004; caDTSE 7. Photocopy of Government Recognition issued by the DepEd dated 10 September 2001, for the N-K-P of the Pre-Elementary Course for the SY 2001-2002; 8. Photocopy of school IDs issued by Petitioner for the School Year 2008-2009. Petitioner submitted its 2008 General Information Sheet and 2007 Financial Statements to prove its intention to continue its registration with the Commission. It also commits to immediately pay the fines as due. On 28 November 2008, Petitioner paid the fine of Php31,750.00 under O.R. No. 0237000, for non-filing/registration of the following, on the years indicated hereunder: NOT FILED FILED LATE General Information Sheet 2001-2006 Financial Statements 2001-2006 2007 Membership Book Registered Late WHEREFORE, finding the Petition meritorious, the Order of the Commission dated 27 June 2006, revoking the Certificate of Registration of LADY OF ROSE ACADEMY, INC., is hereby SET ASIDE.
