A200009031 FOR : Setting Aside the Order of Revocation of the Certificate of Registration O R D E R Petitioner, ASIAMIX BUILDERS, INC. is a stock corporation registered with the Commission on 13 June 2000, under SEC Registration No. A200009031, with principal office at 112 Bayswater Drive, Makati South Hills, Paraaque City, engaged in the general construction business, as stated in its Articles of Incorporation. DACcIH On 02 August 2006, its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated 27 June 2006, published on 03 July 2006 in the Philippine Star, for non-filing of reports. Petitioner now prays for the setting aside of the said Order of Revocation dated 27 June 2006, on the following grounds: 1. that Petitioner intends to continue its operation as qualified management personnel have been appointed and/or hired. 2. that Petitioner has no intention to violate the law and any SEC rules and regulations; and 3. that Petitioner shall henceforth submit its reportorial requirements religiously. In support of its Petition, Petitioner submitted the following documents: * 1. Photocopy of ad clippings of four (4) storey commercial buildings constructed by the Petitioner. 2. Photocopy of the 2007 Income Tax Return received by the Bureau of Internal Revenue on 30 October 2008; 3. Photocopy of 2000 Documentary Stamp Tax Declaration/Return received by the Bureau of Internal Revenue on 29 October 2008; 4. Directors' Certificate dated 23 October 2008, certifying that at the regular meeting of the members and the directors on 02 October 2008, at which a quorum was present, the resolution allowing the filing of Petition to Set Aside Order of Revocation was approved; 5. Owner-Contractor Agreement dated 28 December 2007, with the J.V. Landayan Construction, Corp. on the construction of four (4) storey commercial building in 1576 Gen. Santos St., Bangkal, Makati City. SDATEc Petitioner submitted its 2008 General Information Sheet and 2007 Financial Statements to prove its intention to continue its registration with the Commission. It commits to immediately pay the fines as due. On 03 November 2008, Petitioner paid the fine of Php3,750.00 under O.R. No. 0225549, for non-filing of the following, on the years indicated hereunder: NOT FILED FILED LATE General Information Sheet 2001-2007 Financial Statements 2000-2006 2007 WHEREFORE, finding the submitted documents sufficient to establish Petitioner's intent to continue as a juridical entity, the Order of the Commission dated 27 June 2006, revoking the Certificate of Registration of ASIAMIX BUILDERS, INC. is hereby SET ASIDE. Further, Petitioner is hereby directed to submit its 2008 Business Permit within thirty (30) days from date of receipt hereof.
