A199907923 FOR : Setting Aside the Order of Revocation of the Certificate of Registration O R D E R Petitioner, IEMELIF LEARNING CENTER, INC., is a non-stock corporation registered with the Commission on 1 June 1999 under SEC Registration No. A199907923, with principal office address at Beulah Land Iemelif Center, Marytown Circle, Greenfields 1, Novaliches, Quezon City, organized to provide courses of study in Pre-school and Elementary Education, as stated in its Articles of Incorporation. AcCTaD On 01 December 2005, its Certificate of Registration was revoked by the Commission, by virtue of SEC Order dated 25 October 2005, published on 28 October 2005 in the Philippine Daily Inquirer, for non-filing of reports. Petitioner now prays for the setting aside of the Order of Revocation dated 25 October 2005, on the following grounds: 1. that without juridical personality, the Petitioner will not be recognized by the government's regulating bodies, thus gravely affecting its students; 2. that Petitioner intends to continue its operation; and 3. that it has no intention to violate the law and the Commission's rules and regulations. In support of its Petition, Petitioner submitted the following documents: 1 1. Trustees' Certificate (with attached Resolution) dated 22 September 2008, certifying that at a regular meeting of the Board of Trustees and its Members, held on 10 September 2008, at its principal office at Beulah Land Iemelif Center, Marytown Circle, Greenfields 1, Novaliches, Quezon City, at which a quorum was present, the resolution allowing the filing of Petition to Set Aside Order of Revocation was approved; 2. Certificate of Membership to the Association of Christian Schools International for the School Years covering 2003-2009; 3. Photocopy of the Petitioner's School Register for the School Year 2008-2009; 4. Photocopies of the Petitioner's School Information for the School Years covering 2004-2009 submitted to the Department of Education-Office of Planning Service; 5. Photocopy of Bureau of Internal Revenue (BIR) Form 1702-Annual Income tax Return for fiscal year ending December 2007 received by the revenue officer; 6. Photocopies of BIR Form 1604-CF-Annual Information Return of Income Taxes Withheld on Compensation and Final Withholding Taxes for the School Years covering 2004-2007; 7. Photocopies of Government Permit granting the Petitioner authority to operate Nursery/Kindergarten Course for the School Years 2004-2006 and Complete Elementary Course for the School Years 2004-2006, given by Kagawaran ng Edukasyon-Pambansang Punong Rehiyon; TaCEHA 8. Photocopy of Certificate of Registration with the Philippine Health Insurance Corporation (PHIC), given on 25 August 2005, and a photocopy of PHIC Form RF-1-Employer's Quarterly Remittance Report with supporting PHIC Form ME-5-Contribution Payment Return dated 6 August 2008; 9. Photocopy of Certificate of Membership with the Social Security System (SSS), Quezon City, issued on 23 August 1999, and a photocopy of SSS Form R-5 Contribution Payment Return with corresponding SSS Special Bank Receipt dated 27 August 2008. Petitioner submitted its 2008 General Information Sheet and 2007 Financial Statements to prove its intention to continue its registration with the Commission. It also commits to immediately pay the fines as due. On 17 October 2008, Petitioner paid the fine of P9,000.00, under Official Receipt No. 0222209, for non/late filing/registration of the following, on the years indicated hereunder: NOT FILED FILED LATE General Information Sheet 2000-2007 2008 Financial Statements 1999-2006 2007 Membership Book Registered Late WHEREFORE, finding the submitted documents sufficient to establish the Petitioner's continuous operations since 1999 to present, and its intent to continue as a juridical entity, the Order of the Commission dated 25 October 2005, revoking the Certificate of Registration of the IEMELIF LEARNING CENTER, INC., is hereby SET ASIDE. Further, the Petitioner is hereby directed to submit its 2008 Mayor's Permit and a favorable endorsement from the Department of Education, within thirty (30) days from the date of receipt of this Order.
