September 29, 2008 SEC-CFD ORDER NO. 107-08 IN THE MATTER OF APEX MINING CO., INC. O R D E R The records on file with this Commission show that APEX MINING CO., INC., failed to file its 2007 First Quarter Report (SEC Form 17-Q) within the period prescribed by SRC Rule 17.1 (1) (A) (ii) and to file a complete 2007 Second Quarter Report (SEC Form 17-Q). As a result, the company was ordered to pay a fine of One Hundred Forty Thousand Two Hundred Pesos (P140,200.00) which it paid on May 26, 2008 as shown by Official Receipt No. 0173095 dated May 26, 2008. The company is admonished to take all appropriate measures to ensure its faithful and timely compliance with SRC Rule 17.1 (1) (A) (ii).
