March 17, 2009 SEC-CFD ORDER NO. 040-09 IN THE MATTER OF SAN ANTONIO FINANCING CORPORATION VIOLATION OF SEC MEMO CIR CUL AR NO. 3, SERIES OF 2007, FINANCING COMPANY ACT OF 1998 AND SECTION 26 OF THE CORPORATION C OD E OF THE PHILIPPINES ORDER ON PAYMENT OF PENALTY The records on file with this Commission show that SAN ANTONIO FINANCING CORPORATION failed to file its 2008 1st and 2nd semester Interim Financial Statements and General Information Sheets for 2005, 2006 and 2008 within the periods prescribed by SEC Memo Circular #3, Series of 2007 and Sec. 26 of the Corporation Code of the Philippines, respectively. cDAITS Likewise, it failed to file its Audited Financial Statements for the years 2004 to 2006 within the period prescribed by Section 13 (b) of the Rules and Regulations to implement the Provisions of R.A. No. 8556. As a result, the company was ordered to pay a fine of Forty Two Thousand Seven Hundred Pesos (P42,700.00) which it paid on March 12, 2009 under OR# 0271252. The company is admonished to take all appropriate measures to ensure its faithful and timely compliance with the said circular and law. Any further violation shall subject the company and/or its responsible officers to a heavier penalty pursuant to Memorandum Circular No. 6, Series of 2005 or Consolidated Scale of Fines. SO ORDERED.
