[SEC CASE NO. 3196. December 9, 1987.] NIRA D. ESPlLOY-SALES , petitioner , vs . ORIENTAL PLANTATION, INC., ET AL. , respondents . O R D E R Respondents' ''Motion For Reconsideration" dated November 2, 1987 seeks for the lifting and/or setting aside of this Commission's "ORDER" dated September 22, 1987 which declared the respondents as in default for failure to file their answer within the reglementary period. IESDCH As a justification, respondents in their Motion attribute the delay in filing their responsive pleading to Domingo Roque who himself incurred delay in delivering certain documents to respondents' counsel who, otherwise could have prepared and filed the answer well within the period allowed by law. Considering the lack of facility in determining the veracity of respondents' statement we are giving them the benefit of doubt. IaAScD In view thereof, and in the interest of justice and equity the above-mentioned ORDER of this Commission dated September 22, 1987 is hereby set aside. SO ORDERED. (SGD.) BERNARDO T. ESPEJO Hearing Officer
