[SEC CASE NO. 3167. July 24, 1987.] RICARDO NG, ET AL. , plaintiffs , vs . WACK WACK CONDOMINIUM CORP., ET AL. , defendants . O R D E R The incidents for today's hearing are 1) the defendants' motion for dismissal of action 2) plaintiffs' motion to deposit assessment dues and 3) plaintiffs' application for a writ of preliminary mandatory injunction. Upon motion of counsel for the plaintiffs, he is hereby given a period of five (5) days from today within which to file his opposition to the motion to dismiss and counsel for the defendants is given three (3) days from receipt of the opposition to file reply thereto, after which, the motion to dismiss is considered submitted for resolution. As to the motion to deposit assessment dues, the parties agreed on the following: 1. The plaintiffs will pay the amount of P30,606.29 directly to the defendants. 2. That the plaintiffs will religiously pay the monthly assessment dues in the amount of P897.13, plus the monthly electric bill in the amount of P200.00; 3. That immediately upon the payment of the P30,606.29, defendants obligate themselves to restore all facilities in plaintiffs Apartment Unit No. 401 and for as long as plaintiffs religiously pay the monthly assessment dues and electric bills, defendants will likewise continue providing plaintiffs' unit with the aforesaid facilities; 4. That this arrangement is without prejudice to the outcome of the case. With the agreement of the parties, resolution of plaintiffs' application for a writ of preliminary mandatory injunction has been rendered academic. HTAIcD SO ORDERED. (SGD.) FELIPE S.
