[SEC CASE NO. 3128. October 13, 1987.] ERIC EKKEHARD GEILING, ET AL. , petitioners , vs . IMELDA M. PILAPIL-GEILING, ET AL. , respondents . O R D E R When the case was called for hearing on October 7, 1987, both counsel appeared. Thereupon, said counsel for both parties manifested that there were no prospect of settlement. Thereafter they proceeded with presentation of their powers of attorney. However, counsel for petitioner upon perusal of the special power of attorney presented by respondents' counsel insisted and moved that respondent Carina Pilapil be declared in default, despite of the Commission's oral order to reduce his motion into writing. Upon petitioners' counsel oral motion for reconsideration of the Commission's oral order, the latter reconsidered the same thereby declaring Carina Pilapil in default. This prompted counsel for respondent to request for three (3) days upon receipt of the written order of the Commission, within which to file his written motion for reconsideration of the Commission's order declaring Carina Pilapil in default. cTSDAH The pre-trial (preliminary conference) having been terminated by agreement of the parties, the trial on the merits was scheduled for November 4, 1987 at 9:00 o'clock in the morning.
