[SEC CASE NO. 3083. September 1, 1987.] REYNALDO L. ORTEGA, ET AL. , petitioners , vs . PHILNABANK EMPLOYEES ASSOCIATION (PEMA-AGW) , respondent . O R D E R When this case was called for hearing on the respondent's motion to dismiss last July 15, 1987, only counsel for the respondent appeared. He moved for the dismissal of this case considering that the prayers in the petition is now moot and academic in view of the fact that the election sought by the petitioners have already been accomplished, and for failure to prosecute this case because of the non-appearance of counsel for the petitioners during the previous hearings despite due notice. Acting on the said motion, counsel for the petitioners is given a period of seven (7) days from receipt hereof within which to file his comment and or opposition thereto, thereafter, the aforesaid motion will be considered submitted for resolution.
