[SEC CASE NO. 2970. August 5, 1987.] SPS. ALICIA AND FERMIN CATALAN , complainants , vs . KINGLY COMMODITIES TRADERS AND MULTI-RESOURCES, INC. , respondent . O R D E R In view of the ex-parte motion for production and inspection filed by the complainants, dated July 21, 1987, wherein it was expressly manifested that the same "in effect amends the motion to audit accounts and partake of the nature of a subpoena duces tecum . . .", the Commission considers the resolution of the motion to audit account unnecessary and instead treats the latest pleading of the complainants as a mere request for the issuance of a subpoena duces tecum for the production of the desired documents therein described. WHEREFORE, let a subpoena duces tecum be issued to the respondent corporation or any of its authorized representative who is familiar with the accounts of the complainants. The continuation of the hearing in the above-entitled case is hereby set on September 3, 1987 at 9:30 in the morning. SO ORDERED. (SGD.) ANTONIO M. ESTEVES Hearing Officer
