May 12, 2010 SEC ADMINISTRATIVE CASE NO. 06-04-78 (CED Case No. 01-2651) IN THE MATTER OF URBAN FINANCIAL SERVICES INC. FOR : Revocation of Corporate Registration ORDER In view of the sworn statement by server Mr. Roberto S. Bulacan, SEC Clerk-Messenger, in his Affidavit of Service dated 25 June 2004, stating that: aHIDAE 1) On 24 June 2004 he had served a copy of the Order dated 22 June 2004 issued in SEC Admin. Case No. 06-04-78 for Revocation of Certificate of Registration to respondent corporation, Urban Financial Services, Inc. (Urban) with business address at Urban Plaza, Urban Avenue corner Pasong Tamo, Makati City, and 2) the findings of Mr. Bulacan that respondent Urban no longer exists in the said business address, since a different corporation owns the said business establishment as confirmed by one Jun B. Ilano, information clerk assigned at the said building on the day that Mr. Bulacan served the said Order; This Office concludes that any attempt to personally serve the summons upon Urban at the aforesaid addresses would be a waste of time and effort by the Commission's process servers. Considering the foregoing, and the fact that this petition was filed in behalf of the Commission, service by publication under Section 4-9 of Rule IV of the 2006 Rules of Procedure of the Commission is justified. WHEREFORE, let the SUMMONS dated 12 May 2010, together with this ORDER and a copy of the PETITION for Revocation of Corporate Registration dated 10 June 2004, be immediately posted in the Commission's website (www.sec.gov.ph) for thirty (30) days. Also, let a copy of this Order and the Summons dated 12 May 2010 be published once in a newspaper of general circulation. Respondents may secure a copy of the petition from the Office of the General Counsel of this Commission during office hours. Accordingly, all publication expenses shall be borne by the petitioner. Let the Enforcement and Prosecution Department be furnished a copy of this Order and the Summons for its appropriate action. SO ORDERED. Mandaluyong City, May 12, 2010.
