ORDER As reported by the process server of the Commission, the Summons dated 05 June 2012 was returned unserved because the Treasurer of Mohit Lending & Trading Corp. (Mohit), Jemarie Garcia, cannot be found in the address stated in the Petition. In view of this fact, petitioner Enforcement and Prosecution Department (EPD) filed a Manifestation and Motion praying that a summons by publication be issued at the expense of the Commission. The prayer for issuance of the summons by publication is pursuant to Section 4-9, Rule IV of the 2006 Rules of Procedure of the Commission. 1 Since the whereabouts of the Treasurer of Mohit are unknown and cannot be ascertained, any attempt to personally serve the summons upon her would be for naught. Considering the foregoing, and the fact that this petition was filed on behalf of the Commission, service by publication under Section 4-9, Rule IV of the 2006 Rules of Procedure of the Commission is justified. WHEREFORE, premises considered, let the SUMMONS dated 05 June 2012, together with this Order, be immediately posted in the Commission's website (www.sec.gov.ph) for thirty (30) days. Also, let a copy of this Order and the Summons dated 05 June 2012 be published once in a newspaper of general circulation. Let the respondents be advised that a copy of the Petition (For Revocation of Certificate of Registration) dated 15 May 2012 may be secured from the Office of the General Counsel of this Commission during office hours.
