FOR : Revocation of Certificate of Incorporation ORDER In view of the sworn statement by server Mr. Joel C. Fernandez, Utility/Driver of the Securities and Exchange Commission Baguio Extension Office, in his Affidavit of Service dated 27 April 2010, stating that: 1) when he served the Summons dated 12 April 2010 at the principal address of Abra Development Fund Program (ADFP), Inc. at Rizal St., Zamora St., Bangued, Abra on 21 April 2010, the office was closed, and as per bystanders in the area it is no longer occupied by ADFP, Inc. but by a certain company they know as St. Joseph Insurance; 2) when he served the Summons dated 12 April 2010 to Ms. Conchita "Chit" Quintero at No. 4 Villamor Manzano St., Bangued, Abra on 21 April 2010, Ms. Quintero was not at the given address and nobody could be found therein to receive the Summons; he was told that Ms. Quintero has not been visible in the area for a long time prior to the intended service of Summons; and 3) when he served the Summons dated 12 April 2010 to Mr. Raul R. Salva at Sitio San Juan, Pantoc, San Quintin, Abra on 20 April 2010, he was told that the party is deceased; Mr. Raul Salva reportedly died in 2008. Considering the foregoing, and the fact that this petition was filed in behalf of the Commission, service by publication under Section 4-9 of Rule IV of the 2006 Rules of Procedure of the Commission is justified. WHEREFORE, let the SUMMONS dated 6 July 2010, together with this ORDER and a copy of the PETITION for Revocation of Certificate of Incorporation dated 07 April 2010, be immediately posted in the Commission's website (www.sec.gov.ph) for thirty (30) days. Also, let a copy of this Order and the Summons dated 6 July 2010 be published once in a newspaper of general circulation. Respondents may secure a copy of the petition from the Office of the General Counsel of this Commission during office hours. ISCTcH Accordingly, all publication expenses shall be borne by the petitioner.
