July 16, 2010 SEC ADMINISTRATIVE CASE NO. 01-09-103 (CED Case No. 08-2874) IN THE MATTER OF MIN & FAMILY GLOBAL INC. COMPLIANCE AND ENFORCEMENT DEPARTMENT , petitioner . ORDER In view of the proof of service by server of the Summons dated 27 January 2009, noting that the Min & Family Global Inc. ("Min," for brevity) had already moved out from its principal address at 3202 West Tower, PSE Center, Exchange Road, Ortigas Center, Pasig City, this Office concludes that any attempt to personally serve the summons upon Min at the aforesaid address would be a waste of time and effort by the Commission's process servers. Considering the foregoing, and the fact that this petition was filed in behalf of the Commission, service by publication under Section 4-9 of Rule IV of the 2006 Rules of Procedure of the Commission is justified. WHEREFORE, let the SUMMONS dated 16 July 2010, together with this ORDER and a copy of the PETITION for Revocation of Corporate Registration dated 20 January 2009, be immediately posted in the Commission's website (www.sec.gov.ph) for thirty (30) days. Also, let a copy of this Order and the Summons dated 16 July 2010 be published once in a newspaper of general circulation. Respondent may avail of the copy of the petition from the Office of the General Counsel of this Commission during office hours. Accordingly, all publication expenses shall be borne by the petitioner.
