An Ordinance Adopting/Approving List of Projects Which Will be Chargeable under the Share of the Municipality from Tobacco Excise Tax (RA 7171) for Calendar Year 2015

December 27, 2018 Excerpts from the Fourth Regular Session of the 10th Sangguniang Bayan of San Nicolas, Ilocos Norte Held at the Municipal Session Hall on the 27th Day of December, 2017 at 10:30 o'clock in the Morning. SAN NICOLAS MUNICIPAL ORDINANCE NO. 023-17 AN ORDINANCE ADOPTING/APPROVING THE LIST OF PROJECTS WHICH WILL BE CHARGEABLE UNDER THE SHARE OF THE MUNICIPALITY FROM TOBACCO EXCISE TAX (RA7171) FOR CALENDAR YEAR 2015 WHEREAS , pursuant to RA 7171, the Municipality of San Nicolas, Ilocos Norte has a share in the tobacco excise tax collected for Calendar Year 2015 with a total amount of P648,922.00; WHEREAS , Local Budget Memorandum No. 76, Series of 2017 and recent jurisprudence provide guidelines on the release and utilization of the shares of Local Government Units (LGUs) from the Collections of Excise Tax on Locally Manufactured Virginia-Type Cigarettes Under Republic Act (RA) No. 7171 and Burley and Native Tobacco Excise Tax pursuant to RA No. 8240, as amended by RA No. 10351, chargeable against the allocations to LGUs under the FY 2016 General Appropriation Act (GAA), Republic Act No. 10717, continuing appropriations, and FY 2017 GAA, RA No. 10924; WHEREAS , to fully implement the same and to substantially comply with the rules and regulations on accounting and auditing of government projects using public funds, a list of identified programs, projects and activities are prepared for consideration; NOW, THEREFORE, BE IT ORDAINED THAT: SECTION 1. There is an available fund amounting to P648,922.00 from the proceeds of RA 7171 for Calendar Year 2015. SECTION 2. List of PPAs under RA7171 . The following are the PPAs where the municipality's share from the Tobacco Excise Tax RA 7171 will be utilized : List of Projects to be Funded under R.A. No. 7171 (2015): Infrastructure Project: Name of Project Funding Source Project Cost (Php) 1. Construction/Rehabilitation of Roads (FMR)-Brgy. 16 LBM 76 Annex D P648,922.00 Total: P648,922.00 SECTION 3. Repealing Clause . The provision of any local law or ordinance inconsistent with these rules and regulations are hereby repealed accordingly. SECTION 4. Separability Clause . Should any provision of these rules and regulations be subsequently declared unconstitutional or invalid, the other provisions not so declared and not affected by such declaration shall remain in full force and effect. SECTION 5. Effectivity . This ordinance shall take effect after complying with its posting and publication requirements as provided by the Local Government Code of 1991. CARRIED."
