Allowing Extension of the Time of Payments of Applicable Taxes, Fees, and Charges for Single Unit Tricycle as Defined under Municipal Ordinance Nos. 2008-22 and 2008

SAN NICOLAS MUNICIPAL ORDINANCE NO. 002-18 AN ORDINANCE ALLOWING THE EXTENSION OF THE TIME OF PAYMENT OF APPLICABLE TAXES, FEES AND CHARGES FOR A SINGLE UNIT TRICYCLE AS DEFINED AND PROVIDED UNDER MUNICIPAL ORDINANCE NO. 2008-22 AND MUNICIPAL ORDINANCE NO. 2008-26 RELATIVE TO THE MOTORIZED TRICYCLE OPERATOR'S PERMIT FROM JANUARY 21, 2018 TO JANUARY 31, 2018 WITHOUT SURCHARGES OR PENALTIES WHEREAS , pursuant to Art. 255, IRR, LGC 1991, the Sangguniang Bayan may, for justifiable reason or cause, extend the time of payment of such taxes, fees or charges without surcharges or penalties, but only for a period not exceeding six (6) months; WHEREAS , there is a pressing need to extend the time of payment for single unit tricycle. For this purpose, a single unit tricycle shall mean "the applicant for franchise or franchisee has only one (1) tricycle unit and does not have any other source of income" as defined on the pertinent Municipal Ordinance on the matter; WHEREAS , there is a need of extend the same because they equally have to go through the process like the business permit; NOW, THEREFORE, BE IT ORDAINED BY THE SANGGUNIANG BAYAN IN SESSION DULY ASSEMBLED THAT: SECTION 1. Title. This ordinance shall be known as an "Ordinance Allowing the Extension of the Time of Payments of Applicable Taxes, Fees, and Charges for Single Unit Tricycle as defined and provided under Municipal Ordinance No. 2008-22 and Municipal Ordinance No. 2008 relative to the Motorized Tricycle Operator's Permit from January 21, 2018 to January 31, 2018 without surcharges or penalties". SECTION 2. Extension. The time of payments of applicable taxes, fees and charges is hereby extended from January 21, 2018 to January 31, 2018 without surcharges or penalties. SECTION 3. Separability Clause . If for any reason or reasons, a part or provision of this ordinance is declared contrary to law, morals, public order or public policy, all other provisions shall remain valid and effective. SECTION 4. Effectivity. This ordinance shall take effect upon approval. UNANIMOUSLY APPROVED.
