January 16, 1997 SAN JUAN CITY ORDINANCE NO. 002-97 AN ORDINANCE APPROVING AND ADOPTING THE 1996 SCHEDULE OF VALUES FOR LAND AND 1996 SCHEDULE OF UNIT VALUES FOR BUILDINGS AND OTHER STRUCTURES IN THE MUNICIPALITY OF SAN JUAN, METRO MANILA TO BE USED FOR THE 1997 REVISION Sponsored by: Councilors Vincent M. Mendoza WHEREAS, Section 219 of Republic Act 7160, otherwise known as the Local Government Code of 1991, provides that the Municipal Assessor shall undertake a general revision of real property assessments within two (2) years after the effectivity of the Code and every three (3) years thereafter; WHEREAS, within the two (2)-year prescriptive period, the Municipal Assessor and the Local Government of San Juan, conscious of the economic condition of the country and the request of the people of San Juan for a modest tax burden, have decided not to conduct a general revision of real property assessments; WHEREAS, real property values have already increased tremendously thereby making real property assessments grossly disproportionate to the current realty market values; WHEREAS, because of this tremendous and sudden increase in real property values, the Local Government has decided to conduct a partial revision to at least lessen the gap between the assessments and realty market value; WHEREAS, during the public hearing last November and December 1996, the consensus of the public was to pay their taxes on a staggered payment scheme; WHEREAS, Section 212 of the Local Government Code of 1991, also provides that before a general revision of property assessments is made, there shall be prepared a schedule of fair market values by the Municipal Assessor for the different classes of real property in his local government unit for enactment into an ordinance by the Sangguniang Bayan concerned; WHEREAS, the Municipal Assessor in pursuance, thereof, has proposed the Schedule of Values for land and the Schedule of Unit Values for buildings and other structures; WHEREAS, in pursuance of the Supreme Court decision in G.R. No. 177577, the Schedule of Values have been compared and discussed with the other Schedule of Values in the District of Quezon City and the Assessors therein have jointly agreed that these Schedule of Values are part of the District Schedule of Values. NOW THEREFORE, be it ordained by the Sangguniang Bayan of San Juan, Metro Manila in a session duly assembled, that: SECTION 1. The 1996 Schedule of Fair Market Value for land, attached as Annex A hereof, is hereby adopted. SECTION 2. The 1996 Schedule of Unit Values for buildings and other structures, attached as Annex B hereof, is hereby adopted. SECTION 3. The 1996 Schedule of Values for land shall used for the revision of all land assessments to be conducted in 1997 and taxes thereon shall be collected and made effective in the second quarter of 1997. SECTION 4. The increase in the 1996 schedule of values of land shall be implemented on a staggered basis to wit: A. 40% beginning the 2nd quarter of 1997 B. 70% beginning the 1st quarter of 1998 C. 100% beginning the 1st quarter of 1999 SECTION 5. The 1996 Schedule of Unit Values for buildings and other structures shall be applicable and used in 1997 Revision of all assessments of buildings and other improvements and taxes thereon shall accrue and take effect in 1998. Provided however, that this Schedule of Unit Values shall also apply to new assessments effective 1998. SECTION 6. All Department of Finance (DOF-BLGF) Assessment Regulations, Memoranda, Issuances and Circulars on real property assessments are hereby adopted and made integral part of this Ordinance. SECTION 7. ESTRADA Mayor ATTACHMENT General Provisions for Land 1. As a general rule ,100% base value per square meter for urban (Commercial, Industrial and Residential) lands be applied to all lands within the first strip of 40 meters on commercial and industrial lands sections or zones, and within the 30 meters on residential sections or zones fronting asphalted or concrete streets or roads. CAIHTE 2. Lands beyond the standard depth, i.e. ,40 meters for commercial and industrial lands, and 30 meters for residential lands, if any, shall be valued 75% for the 2nd strip, 50% for the third strip and 30% of the base value fixed for the street or road for the remaining area. Provided, however, that in case the parcel of land abutting two streets or roads on two sides with different based values, the stripping and valuation thereof shall be based on the principal street or road with the higher base values. 3. For low and sunken areas of the land ,a reduction from the base value per square meter may be allowed due to the cost of filling and compaction to bring the same at par with the adjoining developed lots. Provided, however, that such reduction will, in no case, exceed 30% of the base value thereof. 4. Corner influence value of 10% of the base value shall be added to the valuation of lots situated at the corner of two streets or roads. Provided, however, that if the street or roads have different base values, the higher base value shall be used in the computation thereof. 5. Vacant or idle lands located in a purely residential or mixed residential, shall be classified as residential. If such land is located in a purely commercial area, the same shall be classified as commercial. 6. A reduction of not more than 50% of the base market value shall be applied for frequently flooded areas. 7. Road lots shall be valued at 10% of the base value for a particular area while right-of-ways shall be valued at 30% of the base value. 8. Parks and open spaces shall be valued at 30% of the base value of the particular area where situated. 9. As far as properly applicable, this schedule of base market value shall be the controlling ,but where the property to be assessed is of a kind not classified in this schedule of any kind for which a value is not herein fixed, it shall be appraised at the current and fair market value, independently at this schedule. The following kinds of buildings are hereby established: 1. RESIDENTIAL CONDOMINIUM individual ownership of a unit in a multi-unit structure (as an apartment building). 2. COMMERCIAL CONDOMINIUM joint control of a unit affairs vested in two or more units (as in commercial building). 3. HOTEL a building with more than fifteen (15) sleeping rooms, usually occupied singly, where transients are provided temporary lodging with or without meals and where no provisions for cooking in any individual suite. 4. CONVENTIONAL HALL a large room for assembly usually equipped with seats. 4a. AUDITORIUM a room, hall, or building used for lectures, speeches, concerts, etc. 5. HOSPITAL a building or institution where sick injured persons are given medical or surgical care. 6. APARTMENT BUILDING designed for dwelling of four or more families living independently of one another and going their household shores independently in their particular premises with one (1) or more common entrances. 7. OFFICE BUILDING a building mainly for stores and/or offices. 7a. BANK an establishment for the custody, loan, exchange or issue of money, extension of credit and for facilitating the transmission of funds by drafts or bills of exchange. 8. CATHEDRAL a church that contains the official throne of the bishop and that is the principal church of the diocese. 8a. CHURCH a building set apart for public especially Christian worship. 8b. CHAPEL a building or portion of a building or institution (as a palace, hospital, college, etc.) as a part for private devotion and often also for private religious services. 9. RESTAURANT an establishment where refreshments or meals may be procured by public, a public eating house. 10.
