February 6, 1957 REVENUE REGULATIONS NO. V-52 SUBJECT : Amendment to Sections 1 and 8 of Revenue Regulations No. V-50 TO : All Internal Revenue Officers and Others Concerned Pursuant to the provisions of Section 338, in relation to Section 4 (j) of Commonwealth Act No. 466, otherwise known as the National Internal Revenue Code, the following regulations amending Sections 1 and 8 of Revenue Regulations No. V-50, otherwise known as Regulations on Wholesale Dealers of Virginia Leaf Tobacco, are hereby promulgated and shall be known as Revenue Regulations No. V-52. SECTION 1. Section 1 of Revenue Regulations No. V-50 is hereby amended to read as follows: Sec. 1. Definitions. "Wholesale Dealer of Virginia Leaf Tobacco" includes one who procures and receives only locally produced or grown Virginia leaf tobacco and warehouses, sells or offers for sale, delivers, barters or exchanges for himself or on commission not less than one standard bale, cask or hogshead of such leaf tobacco at any one time. "Bona fide Virginia leaf tobacco planter" includes the following: (a) a person whose stock of Virginia leaf tobacco is produced by him in a land of which he is the owner or lessee, or (b) a crop sharing tenant which shall mean a person who, himself and with the aid available from within his immediate farm household, cultivates the land belonging to, or possessed by, another, with the latter's consent for purposes of production, sharing the produce with the landholder under the share tenancy system; or (c) a leasehold tenant which shall mean a person paying to the landowner a price certain as ascertainable under the leasehold tenancy system. For purposes of these regulations, the fact that a person is a bona fide Virginia leaf tobacco planter should be certified to by means of a certificate to be issued by the Deputy Provincial Treasurer of the locality where the leaf tobacco is produced or grown. The certificate is valid as long as the holder thereof continues to be a bona fide Virginia leaf tobacco planter, but only until the end of the year, unless renewed for another year, which renewal should be made during the month of December before the succeeding year. The certificate should be serially numbered and the number should appear before the name of the municipality where issued, such as "1-Bacnotan", 2-Bacnotan, 3-Bacnotan, etc." Likewise, the certificate should be accomplished in quadruplicate, the original of which should be issued to the planter, one copy each should be forwarded to the Provincial Revenue Officer of the province concerned and the Collector of Internal Revenue and the remaining copy to be kept by the Deputy Provincial Treasurer for his file. SECTION 2. Section 8 of Revenue Regulations No. V-50 is hereby amended to read as follows: Sec. 8. Limitation on holders of L-3 permits. All L-3 holders whose permits were granted before the effectivity of these regulations and those who have already secured and paid their B-14 privilege tax-receipts for the year 1957 shall be allowed to continue to handle flue-cured and sun-dried Virginia type tobacco. HScAEC However, as regards farmer's cooperative marketing association (FACOMAS) already organized as well as persons and entities already with redrying plants or flue-curing barns, they shall re-apply for the new permit required by these regulations the moment these regulations shall take effect. Nothing in these regulations shall be construed to prohibit manufacturers (L-7) of Virginia-type cigarettes to buy Virginia type leaf tobacco from the farmers, L-4 holders, and cooperatives, or any private dealers. SECTION 3. Date of Effectivity. These regulations shall take effect upon promulgation in the Official Gazette. (SGD.) JAIME HERNANDEZ Secretary of Finance RECOMMENDED BY: (SGD.)
