July 31, 1978 REVENUE REGULATIONS NO. 14-78 SUBJECT : Transferring the administration and collection of the Special Metropolitan Flood Tax under Presi dential Decree No. 1 8 TO : All Revenue Officers, City/Municipal Treasurers of Local Government Units of Metropolitan Manila and others concerned Presidential Decree No. 18 promulgated on October 7, 1972 created a Metropolitan Manila Area and Drainage Fund and one of the revenue sources therein identified as accruing to the said fund is the: "(a) Proceeds from a Special Metropolitan Flood Tax of twenty-five (P0.25) centavos levied on all admission tickets of movie houses in Greater Manila for a period of fifteen (15) years." xxx xxx xxx In pursuance of the aforequoted provisions of the decree, Revenue Regulation No. 16-72 prescribing the rules and regulations governing the administration and collection of the tax was issued by this Ministry, upon recommendation of the Commissioner of Internal Revenue, as at the time of promulgation of the decree the responsibility for and the authority to enforce the collection of the amusement tax on admission to movie houses, among other amusement places, was vested in the Bureau of Internal Revenue. With the enactment, however, of Presidential Decree No. 231, otherwise known as the Local Tax Code, which took effect on July 1, 1973, the power to levy and collect amusement tax on admission tickets of movie houses and other places of amusement was transferred to the local governments in view of which the Commissioner of Internal Revenue has recommended that the administration and collection of the Special Metropolitan Flood Tax be transferred to the city/municipal treasurers of cities and municipalities in Metropolitan Manila. In view thereof, Revenue Regulation No. 16-72 dated December 8, 1972 is hereby revoked and the responsibility of administering and collecting the Special Metropolitan Flood Tax of P0.25 on all admission tickets of movie houses in Metropolitan Manila, levied under Presidential Decree No. 18, are transferred from the Bureau of Internal Revenue to the local treasurers of Metropolitan Manila, effective October 1, 1978. The Metropolitan Manila Commission, shall, with the approval of this Ministry, issue the corresponding guidelines, rules and regulations governing the administration, collection and remittance to the National Treasury of the Metropolitan Flood Tax to all city/municipal treasurers of cities/municipalities of Metropolitan Manila, for their information, guidance and compliance.
